Krauthammer: Withdraw Miers Nomination

President Bush should withdraw his nomination of Harrier Miers to fill the Supreme Court seat of retiring justice Sandra Day O'Connor, says Washington Post columnist and Fox News commentator Charles Krauthammer.

In a blistering Post column Friday Krauthammer, normally a strong Bush supporter, wrote that if Miers weren't a Bush crony, "her nomination to the Supreme Court would be a joke, as it would have occurred to no one else to nominate her."

Noting that there are 1,084,504 lawyers in the United States, Krauthammer asked: "What distinguishes Harriet Miers from any of them, other than her connection with the president? To have selected her, when conservative jurisprudence has J. Harvey Wilkinson, Michael Luttig, Michael McConnell and at least a dozen others on a bench deeper than that of the New York Yankees, is scandalous."

The columnist called the fact that Miers has been chosen by a conservative president "particularly dismaying. For half a century, liberals have corrupted the courts by turning them into an instrument of radical social change on questions – school prayer, abortion, busing, the death penalty – that properly belong to the elected branches of government. Conservatives have opposed this arrogation of the legislative role and called for restoration of the purely interpretive role of the court. To nominate someone whose adult life reveals no record of even participation in debates about constitutional interpretation is an insult to the institution and to that vision of the institution."

Krauthammer predicted that Miers will "surely shine in her Judiciary Committee hearings," but explained that she will do so "only because expectations have been set so low. If she can give a fairly good facsimile of John Roberts's testimony, she'll be considered a surprisingly good witness. But what does she bring to the bench?"

However, the "Impeach Bush" statement from Coulter is a departure from her usual behavior. I had seen an immature streak in her before but I had not realized the depth to which it went.

It's irreverence. As an irreverant persona, I enjoy most of her work. I thought her anti-Miers piece stunk. Stunk bad.

Karuthammer liberal???? I dont think so! H'es brilliant, suually. It's dismaying that he would take such a public stance against Pres Bush's decision. Which I feel in my heart is a decision made by a President who is acting in a disturbing way.

"Trust me" he says to us, his base. I think not, Mr President. I would like to but I can't. You are not infallible. The hemorrhage of illegal immigration swamping our nation continues unabated during your watch. The democrats in the Senate do not deserve your unfailing civility. Islam is not "a religion of peace". And Scalia should have been the Chief Justice.

I've had critisism of Kraut in past, but he is no Liberal.

I suspect if the Pope critisized this selection he'd be called the anti-Christ, or lesser degree, discriminatory to evangelicals.

Of course, he is not an American but the simple point is no matter who stands to voice dissent, no matter what moral, intellectual, conservative, pro-Bush credits they carry...they must be destroyed.

Don't bet on it. Neither party is going to nominate a Supreme Court Justice that realizes the Constitution's intent was to set limitations for the most part on the federal government alone. Get Brown, Thomas, and three other Justices to agree with them (however wrong the basis for the other three Justices arguments may be) and the national government, along with its power, could be shrunk overnight. No politician is going to set the stage to give away his or her power

Any decision she makes is up for review by SCOTUS. One can say they believe in limiting government, but makes sure the reviewers are not as Constitutionally minded as she is. Some of her decisions will be overturned by SCOTUS, some may not. But with her on SCOTUS any decision she is involved in, if she is in the majority would not be overturned.

The whole problem is "scholars" reading more into it than is there.

Read the opinions of Justice Scalia, a scholar if there ever was one, and you'll change your opinion. There are great people who went to elite schools and complete dopes who went to less elite schools. That isn't the issue. My hope for this nomination had been another Scalia. I don't care where a nominee went to school. I want a nominee whose respect for following the Constitution is well-established.

Irreverance is bad when directed toward good causes.

She's too strident for me, I see the need to rah-rah the conservative troops which her personality does in many quarters and I'm grateful if she is reaching Bill Maher viewers when she appears on his show.

Although I liked and appreciated the McCarthy parts of her book "Treason", I find her writing to be droning.

Your post smacks of elitism. If it's elitist to want the best people for the most important jobs, then I'm for it in this case.

I am not elitist, I just do not understand how it is considered a bad thing to be excellent.
Why do we help our kids with their homework, save money for their education and support them in their endeavors if it is not out of a sense of wanting them to be the very best they can be?

Now people are saying the very best are somehow undesirable?? Time to do away with scholarships, awards, The Super Bowl etc...
