ROBERT BORK CALLS THE HARRIET MIERS NOMINATION "A DISASTER" ON TONIGHT'S "THE SITUATION WITH TUCKER CARLSON"

SECAUCUS, NJ - October 7, 2005 - Tonight on MSNBC's "The Situation with Tucker Carlson," former judge and Supreme Court nominee Robert Bork tells Tucker Carlson the Harriet Miers' nomination is "a disaster on every level," that Miers has "no experience with constitutional law whatever" and that the nomination is a "slap in the face" to conservatives.

Following is a transcript of the conversation, which will telecast tonight at 11 p.m. (ET). A full transcript of the show will be available later tonight at www.tv.msnbc.com. "The Situation with Tucker Carlson" telecasts Monday through Friday at 11 p.m. (ET).

I think we are seeing a slight tinge of "elitism" with regard to many on the right that are opposing her..

Man, are you way off base.

The simple truth is that by rejecting normal mainstream conservative judges such as Janice Brown, Pricilla Owens, Michael Lutig, etc. -- we are allowing the Dems and the media to characterize them as extreme, loony right wing judicial activists.

"See, even George Bush would not nominate THOSE judges," the libs are saying.

Look, Harriet Miers might be a great lady, and despite her apparant mediocrity, she might be a good Judge.

But what GWB has done here is poison the waters for years, if not decades, for anyone wishing to nominate a good mainstream conservative Judge for the US Supreme Court.

Lawyers.. we are talking about worthless scum bag lawyers.... I am happy to see an outsider... Hell, I'd prefer a business leader to a "constitutional expert" whatever the hell that means....

WHAT THE HELL IS A CONSTITUTIONAL EXPERT ANYWAY?

If some jackass has to spend his life trying to build or create or study what the Constitution means, then he is thinking way too hard, because what the constitution means is written right there in black and white. Leave it to lawyers to complicate and destroy.

I'd take a plumber to a judge.

You know, aside from the disagreement on this appointment, which I can understand, I have been absolutely turned off by the numbers of commentators who cannot make their case without cheap shots and vulgar insults.

If this nomination is so important to these people, one would think that they could marshal some elevated language to convince people. Instead, we get words like flak, crony, Church Lady, clueless, etc.

I am a student of unintended consequnces, and the pundits may be earning their own. I have zero respect for many of them anymore.

According to said post Bork made the following statement in Slouching Towards Gomorrah:

"The Second Amendment was designed to allow states to defend themselves against a possibly tyrannical national government. Now that the federal government has stealth bombers and nuclear weapons, it is hard to imagine what people would need to keep in the garage to serve that purpose.''

Bork by his own writing has stated the RTKBA is anachronistic. How can an originalist state the BOR doesn't apply today as it did yesterday unless he believes in some form of living document which changes with the times and technology.

If this is an example of a well defined judicial philosophy such a thing may be overrated.

Some people are intentionally dishonest. She voted for Bush I in the *primaries*, but contributed to the DNC to support Comrade Dukakis days before the 88 election. Doesnt make sense does it?

That doesnt stop the usual suspects here from distorting the facts!

Did you post that with a straight face?

She voted for single member districts, rather than the at-large districts that were prevalant in Dallas prior to 1991.

Do you not think that geographical areas of a large city deserve a designated representative on the council?

I look at it as the last straw. As a non party conservative, one that voted for Bush, I think many of us have finally had enough.

For the pubs this does not bode well in 06 and 08. Look at the personal hate directed our way here on FR. They asked for our votes and support, we did both, now we are lowest of the low and no name is too vile to bestow upon us.

"Stealth conservatism" The wave of the future. Pretty soon it will be so stealthy as to be undetectable.

I'm sure the nomination has poisoned the waters for years, but it certainly doesn't feel like advancing the cause. It feels like BOHICA.

Or Bork may be overrated. Either way, I don't want him on the SCOTUS and his opinions on who should be there carry little to no weight with me. I still like him and think he is a good jurist for the most part but he has fatal flaws in my eyes.

And if I see fatal flaws in Harriet Miers during the hearings I won't hesitate to call my Senators and urge them to reject her nomination. Of course Dodd and Lieberman won't need my urging nor have they replied to me in the past 8 years or so. But that won't stop me from being heard. :-}

If their personal privileges are at stake, you damn well bet they will. For example, if McCain is responsible - even partially - for a defeat of a quality conservative nominee, that will put a permanent end to his Presidential ambitions... at least as a Republican. The rest are weak-willed enough that if you threaten to take away their executive washroom keys they can be persuaded.

This is simply a matter of will. Do any of the folks we elected for the primary purpose of reversing the usurpations of the judiciary have the will to follow it through?
