Federal prosecutors have accepted an offer from presidential adviser Karl Rove to give 11th-hour testimony in the case of a CIA officer's leaked identity but have warned they cannot guarantee he won't be indicted, according to people directly familiar with the investigation.
The persons, who spoke only on condition of anonymity because of grand jury secrecy, said Special Prosecutor Patrick Fitzgerald has not made any decision yet on whether to file criminal charges against the longtime confidant of President Bush or others.
The U.S. attorney's manual requires prosecutors not to bring witnesses before a grand jury if there is a possibility of future criminal charges unless they are notified in advance that their grand jury testimony can be used against them in a later indictment.
Rove has already made at least three grand jury appearances and his return at this late stage in the investigation is unusual.
The prosecutor did not give Rove similar warnings before his earlier grand jury appearances.
Problem is prosecutors are in the business of finding someone to blame for everything. He was appointed for a reason, so he assumes a crime must be there; otherwise why ask for him to look into it. It's just human nature. Plus it's tempered by the fact...if he's wrong the jury will acquit. I'm sure that info will be brought up at trial (if it goes to trial..usually these guys get a plea bargain like Sandy Burglar).
Rove will face prison time if he loses or admit to guilt and get probation. Either way his political career is over. The damage is done. Remember this isn't a local state prosecutor like the Delay case. If an indictment comes out against anyone it will hurt.
O'Donnell predicted that a couple of people would be indicted in this case.
I can't stand O'Donnell, but he was the first person to identify Rove as a source for Cooper, from Time magazine.

So either she's lying or someone else is (maybe Rove), and Fitzgerald wants to get to the bottom of it.
Hard to prove, but quite easy to charge someone with it.
If that is the case, I'm betting Rove has notes and Miller doesn't.
Even if he gets indicted, all Rove needs to do is to run out the clock until one day after the '08 election. Then its pardon time. If McCain is the GOP candidate, Bush might not even wait that long. It will be two-for: a going away gift for a loyal soldier and a kidney punch to a disloyal one.
Prosecutors aren't calling him...he's going because he wants to correct a statement he's made.
O'Donnell also wrote today that Rove received a target letter because Rove's lawyer failed to deny receiving one. He just did so today (that is, Rove's lawyer denied receiving a target letter). So O'Donnell has no more inside info than we do. He's just speculating. People who speculate are sometimes right, and they're sometimes wrong.
Nothing that happens in this Grand Jury is confidential or secret, even if it should be.

Could this be the reason why W picked Miers just in case Rove or anyone else is indicted? That way there would not be two major political battles this large going on at the same time? No tin foil, just a thought.
I have a question - is the prosecutor a Democrat? Ever since Miller got out of jail and Fitzgerald (Fitzpatrick, whatever his name is) made a deal with her not to ask about her other sources (supposedly) I'm beginning to wonder if this is going to end up with an indictment of Rove. Yeah, yeah, I have my tinfoil hat on and maybe you need one to read this, but I started wondering at that point when nothing made any sense about why she would sit there for 3 months and suddenly just before his grand jury ran out, she would decide to testify. What if this is just another indictment like Delay's to get rid of Rove for the '06 election. The Dimwits are terrified of Rove. Most of this "corruption" crap is beginning to look like a playbook for the '06 election including the Dimbulbs having a Contract on American starting with HillaryCare. Looks like they are just borrowing Newt's from '94 and creating things to fill in the blanks.

Hard to prove, but you don't have to prove anything to bring an indictment. The only thing he's really got going for him is that the case is in NY. Better there than DC, though not much.
