I'm sure there are. The question at hand, though, is what amount of risk this President should be willing to take in assuming that Miers was a closet conservative during this time period?
Sorry for not posting a full record of your response - I must have overlooked one of your posts on this huge thread - I saw the one about this costing the ABA members, but didn't see a follow up - I am not trying to misrepresent either of our views.
I would agree that Miers' personal stance may or may not have been revealed by her action on behalf of the Texas Bar. But I can tell you with absolute certainty that the impetus to bring the abortion issue to a vote of the full ABA membership came from the pro-life side, in direct response to the ABA leadership having adopted pro-abortion positions.

What is more relevant is matters such as the ACLU trying to get more "rights" for detainees at Gitmo, not appeals of matters regarding the UCMJ.

If the Dems want to be seen to obstruct the nomination of someone like JRB, then I think that's a fight worth undertaking. Frankly, the political consequences are likely to benefit the GOP no matter what the outcome. At worst, Brown is not confirmed and the GOP base is energized for 2006. At best, she's confirmed and we have a certain conservative vote on the bench for the next few decades.
What's the downside?

The downside is that not enough people in this country understand or relate to the judicial philosophy of JRB. So the Dems would have a field day with her. I would love to see her on the court, but that ain't happening for a few years yet.
Perhaps Janice Rogers Brown is happy where she is and is tired of the fight.

Shelia Jackson Lee should keep doing what she is doing as she doesn't stand a chance of getting a job in the private sector doing real work for a real company. And the Gang basically took power from Frist, Specter and Reid regarding nominations. They hold the cards now.
Hate to break in on this late, but those 7 RINOs also had an "out"; if they determined that the "extraordinary circumstances" weren't extraordinary, they could break their pledge.
What's worse, since Roberts didn't draw the "extraordinary circumstances" line, why in the <expletive deleted> did President Bush feel it necessary to nominate someone more likely to be either a clone of O'Connor or Souter than one of Roberts (much less Scalia or Thomas)?

That's certainly possible. Honestly, I think the current political climate is enough to deter the vast majority of good people from seeking positions in DC.
Some of us have been fighting the growth of this monster called the federal government for over forty years.
This giant vacuum that consumes the rights ,freedoms and dollars of every hard working patriotic American in this country.
It is so controlling in it's reach that it even governs and consumes the rights of millions at the moment of their birth by puncturing their brains and dismembering them or starving to death those that are old or sick so it can save a few bucks to give to the PLO.
The Republicans were given a once in a lifetime opportunity to down size and rein in this beast and return some of the power back to the people it was supposed to serve.
It has long ceased being our servant and become our all-knowing master.
Instead they chose to make it bigger and more powerful.
The only thing they have downsized is that we need the most, decent paying jobs, secure borders and our military.
Now instead bringing some sanity to our courts by choosing judges who believe in the documents and the God who established our country, they choose to leave in the hands of men who think they are gods and know better what kind of laws and country we need.
The legacy of the Republicans and G.W.Bush will be that while they had control of the House, the Senate and the Presidency for eight years they have squandered the last chance our country had of surviving as a great nation and a beacon of hope for the ability of humans to govern themselves .
This chance won't come again.
The signs are everywhere for those that would see, that we are fixing to join the other great nations of history on the ash heap of "use to be" greats.
Once again, those seven are RINOs. They would not go along with someone like Janice Rogers Brown, and would probably be inclined to agree with the Dems that she would be too extreme. And two of the Gang are Snowe and Collins and both wanted a female to replace O'Conner.
The only thing that was saving the Republican party was that they weren't on board with the baby killers. Take that away and they have sh1t left. TIME TO RAISE HELL! ITS NOW OR NEVER
