Nursing Home Cited After Resident Allegedly Beats Roommate To Death Both Residents Reportedly Had Mental Issues

POSTED: 6:51 pm EDT September 29, 2005 UPDATED: 7:04 pm EDT September 29, 2005

WASHINGTON COURT HOUSE, Ohio -- Investigators are examining a report of a fatal assault at a Central Ohio nursing home.

The problem began as an argument over a TV set between two roommates at Carlton Manor nursing home on Sept. 2, NBC 4's Erin Tate reported.

Police are investigating the fatal assault of 61-year-old Daniel Jacob, but said they weren't notified of the incident until the next day.

According to a health department report, there was an initial argument over a TV set between Jacob and his 60-year-old roommate, both of whom had behavioral issues.

"They were just placed back in their beds and one of them wasn't removed," said Michelle Loparo, of the Ohio Department of Health.

Just 30 minutes later, officials said Jacob's roommate was found kicking and stomping him in the head, face and chest.

Jacob died the next day, and the state said the nursing home failed to recognize and properly assess the severity of the injuries.

"Some of the residents were in jeopardy because the resident who allegedly caused the abuse … we don't believe had adequate supervision," Loparo said. "Had that particular resident had adequate supervision, that death might have been prevented."

Jacob's roommate had been recently diagnosed with anxiety, depression and agitation due to paranoid schizophrenia.

The state cited the nursing home for not addressing his aggression appropriately and for putting other residents in jeopardy by not monitoring him more closely.

"We want to make sure the facility is specially trained and capable of protecting the health of all the residents," Loparo said.

The nursing home was fined nearly $4,000 and cited for seven violations, including not reporting the death of a resident to the state sooner.

There are additional penalties, but the administrator said he is disputing some of the alleged violations.

The roommate is suspected, but no charges have been filed.

You can't kick the guy with schizophrenia out of the nursing home because of ADA or some other discrimination law.... and now someone is dead.

It's not like the guy just sat there and let life pass him by. I mean, if you're 60 years old and still able to beat and stomp someone to death, it demonstrates a certain level of initiative.

Good point. If you can still hold your own in a bar fight, despite Parkinson's and early onset senile dementia - it's quite an accomplishment. Rightly honored.
