SACRAMENTO - Gov. Arnold Schwarzenegger followed through Thursday on his promise to veto a bill to legalize gay marriage in California, saying the issue should be decided by voters or the courts.

“This bill simply adds confusion to a constitutional issue,” the Republican governor said in a veto message. “If the ban of same-sex marriage is unconstitutional this bill is not necessary. If the ban is constitutional this bill is ineffective.”

Too bad the entire article wasn't posted from another site that carries the AP wire story.. this little part is left out.. Coincidence?

He wants to leave it up to the people and the courts.. and knowing the track record of courts here of late,, this is hardly a victory, ... besides, the Gub supports civil unions.

This is great. However, he is wrong in believing the courts should in any way have anything to do with the establishment of any law that would allow homosexuals to marry - or any law for that matter.

Schwarzenegger vetoes gay marriage bill
Steve Lawrence
AP-San Diego Union-Tribune
September 29, 2005

SACRAMENTO – Gov. Arnold Schwarzenegger followed through Thursday on his promise to veto a bill to legalize same-sex marriage, saying the issue should be decided by voters or the courts.
"This bill simply adds confusion to a constitutional issue," the Republican governor said in a veto message.

Schwarzenegger said he would veto the bill Sept. 7, a day after the Legislature became the first in the country to approve a bill allowing gays and lesbians to wed.

Schwarzenegger said the bill by gay Assemblyman Mark Leno, D-San Francisco, contradicted Proposition 22, which was approved by voters in 2000 and said only a marriage between a man and woman is valid.

While a San Francisco Superior Court judge ruled that the ban is unconstitutional, Schwarzenegger noted that the case is before a state appeals court and will likely be decided by the California Supreme Court.

"If the ban of same-sex marriage is unconstitutional this bill is not necessary," he said. "If the ban is constitutional this bill is ineffective."

He said the state Constitution barred the Legislature from enacting a law allowing gay marriage without another vote of the people.

Eddie Gutierrez, a spokesman for Equality California, a gay rights group that supported the bill, said Schwarzenegger had merely delayed the day when gay marriage is legal.

"We are extremely disappointed with the governor's decision," he said. "By denying us marriage equality he has turned a back to our community."

California voters will get the chance to say NO to the Left here next June by enshrining a ban on same sex marriage into the State Constitution.
