Actually, Earle could lose his qualified immunity and be sued for malicious prosecution if it were to turn out that he had no probable cause to bring the charge.
There are difficult technical problems that would make it difficult for DeLay to sustain a malicious prosecution lawsuit against Earle, but such a lawsuit is by no means impossible.
Well, at least you didn't head off to take a shower, and ask to be informed of any future developments :-)
I'm on DeLay's side in this blatant political effort to bring him down.
Earle got an indictment from a grand jury. Malicious prosecution would be tough unless he intentionally and fraudulently committed fraud.

The media sure won't help him out. I happened to catch CBS radio news as I was driving home. They didn't say one thing about his statement. They can't let the truth get in the way.
