Man Charged With Animal Cruelty After Tossing Kitten To Pit Bull

Nicholasville, KY (AP) -- A man was charged with first-degree cruelty to animals after allowing his pit bull to maul a kitten to death, police said.

Roger Alan Fairchild, 24, of Nicholasville is accused of taking the kitten named Midnight on Sept. 1 and pitching it to his pit bull named Damien, police said. Fairchild was charged shortly after he threatened to order the dog to attack two officers, police said.

The kitten belonged to Shanelle Crowe, 12, who lives in an apartment complex behind Fairchild's home.

Shanelle did not witness the incident, but apparently other youngsters did, police said.

The kitten often wandered up and down a sidewalk in front of the apartment complex. On the night of Sept. 1, several youngsters were petting the kitten when Fairchild walked up and grabbed it, said Nicholasville police Lt. John Branscum.

"A 12-year-old who had the cat in her lap asked 'What are you doing?' and he said, 'I'm feeding my dog,"' Branscum said. Fairchild then took the kitten inside his home. One girl followed in an attempt to retrieve the kitten and saw Fairchild throw it to the dog.

Fairchild initially was charged with disorderly conduct, resisting arrest, terroristic threatening and menacing, all misdemeanors, and lodged in the Jessamine County jail.

He wasn't charged with the felony animal-cruelty charge until this week, Branscum said, because it took several days to get a warrant signed.

Shanelle Crowe's father, Tom Crowe, said his daughter and 17-year-old stepdaughter "were pretty bad for a while" but have since acquired a kitten named Blackie.

Really good question.

My take on it is that the difference is that both dogs and housecats are uniquely bound to humankind, unlike any other animal that I can think of, in that they helped create an environment where humans could engage in agriculture and ultimately advance to more civilized societies.

Dogs and housecats (I say housecats to differentiate from cats in general, which include cougars, jaguars, tigers lions, bobcats, etc.) were not animals of toil, like oxen or horses, or food sources, like cows and poultry. Instead, they were "employees" in a sense. For food and lodging, so to speak, they earned their keep: cats kept down the rodents and reptiles (I've been told that storage of grain was virtually impossible without the help of cats to control rat populations), and even today a good gopher-hunting cat when you've got a large yard is very convenient!). Dogs did and still do help herd animals, help men hunt game, protect children and families, kill rodents, and so forth.

Snakes and mice, on the other hand, share no such symbiotic or sympathetic bond with us. That, for me, justifies the difference in tossing a mouse to a snake and not thinking twice, while finding abhorrent the tossing of a cat to a pit-bull. Interestingly, I would be just as disgusted to hear of a man who threw, say, a good Australian Shepherd or a worthy hound, to a tiger. A family I knew as a kid had an Australian Shepherd who took a hit from a rattlesnake to protect one of the kids. The dog would have died, except that its owners were able to get it to vet in the nick of time. I have heard of cats that have woken whole families to get them out of burning houses. Have never heard of a snake or a pet mouse do something comparable!

How long will it be before "cruelty to animals" is used for cows, chickens, pigs, etc? Who decides whats cruel and whats not?

There's a difference between slaughtering farm animals for human consumption and picking up a kitten that belongs to someone else (while other children were playing with it) and throwing it to your pit bull for it to eat.

A clear definition of cruelty to animals for one and who decides what animals you can be cruel to and what animals you cant. Step back and take a good look. Most of these replies to my post seem to come from the PETA hand book (if there is one I don't know). Cases like this set a precedent
that can be used by libs, PETA, and envirowhackos. I was suggesting the private property laws be used instead.

If you had a pet snake and I grabbed it by it's tail and slammed it on the floor would I not be charged with cruelty to animals? Or would I be charged with destruction of private property? Of course I would probably get my a$$ kicked but thats beside the point.

The kitten was someone's pet. Dog food is available at the store. You don't go to the pet store and buy feeder kittens.

Neuter the dog and shoot the man. This is the kind of person who is thoughtless ( obviously) and careless, and will allow his dog to run loose and attack your children. I speak from experience (I am a pediatric nurse) when I say I am SICK of taking care of kids bitten by wandering dogs. The pit bulls do the most harm, they bite and don't let go. It embarrasses me that this 'human' lives in KY.

Legally, I don't know, but it would be sensible and logical to charge you with destruction of private property. Morally, I personally would vote "not guilty" on the cruelty to animals charge, even though I like snakes and had plenty as pets (temporary ... my mom always made me let 'em go) as a kid, and I ADORE lizards. But they're ... snakes and lizards, not right bright.

Bottom line: I'm all for species profiling. Dogs and housecats are at the top of the list of those to be favored and safeguarded against cruelty, if only because of their "independent contractor" status in human history and civilization-building that is unique in the animal kingdom. They helped us get where we are! Many popular pet birds, like macaws and African greys, even ridiculous little parakeets, are highly intelligent, so I (if anybody asked) would put them on a cruelty-safeguard list.

The more intelligent the animal, the more likely I would give it "safeguard" status in charges of animal cruelty. Insects, rodents (yes, I had my share of rodent pets as a kid, and know how surprisingly intelligent they can be), domesticated stock animals bred for human consumption, I think are off the safeguard list. Of course you're going to get people who will say sending them to the slaughterhouse is cruel, but again, I'm all for profiling and have no problem making judgement calls, such as it's okay to slaughter a highly intelligent pig for market, but not okay to slaughter a less-intelligent chihuahua for kicks. Call me inconsistent, but what human isn't?

I don't like wanton torture or cruelty to any critter, not even a spider. As a little girl, I used to kick ass on the playground when I saw boys being boys and stabbing ants one by one with toothpicks! I was a redhead, what can I say. But personally I am convinced that the person who indulges in true torture and cruelty to any animal suffers his own kind of hell.

"Some people are ... sensitive to finding their name on an animal. I am, for example," said Genevieve Ste.-Marie, who issued the order as director of the National Museum of Science and Technology. "Let's say you came in and found your name on a cow, and you thought the cow was old and ugly." Names like Clover, Rhubarb and Buttercup were still deemed okay, with borderline cases such as Daisy being decided on a "cow-by-cow basis". Also cited as acceptable was "Bossy"."
