BINGHAMTON, NYA U.S. soldier has testified in federal court Tuesday (September 20) that he was splashed with human blood by anti-war protesters during a 2003 protest.
The soldier, Staff Sgt. Rachon Montgomery, was working as an army recruiter on March 17, 2003, the day that four protesters threw their own blood around a recruiting center in Lansing, NY, a suburb of Ithaca. As a result of the incident, press reports indicate, Montgomery was tested for blood-borne illnesses such as HIV and hepatitis.
In addition to Montgomery, the protesters also poured blood on the American flag, a military banner and the walls and floor of the center.
The protesters, Clare Grady, Teresa Grady, Peter De Mott and Daniel Burns, all of Ithaca, are currently on trial in Federal Court in Binghamton on charges of conspiring to impede the duties of U.S. officials and damaging or injuring federal property and officials. The conspiracy charge, the most serious, carries up to six years in prison and a $250,000 fine.
The protesters, who have dubbed themselves the St. Patricks Day Four, while admitting to their actions, claim they have done nothing wrong. The four, who are representing themselves, claim that their actions were legally justified because they did it to stop the United States from invading Iraq.
That defense was accepted in an earlier state court trial in Ithaca, which resulted in a hung jury.
However, according to the New York Times, District Court Judge Thomas McAvoy is allowing the defendants to talk about their state of mind at the time of the protest in their opening arguments, but not to raise their belief that the Iraq war was illegal or immoral.
The groups supporters, many of whom are from the Ithaca, have conducted a daily vigil outside the courthouse, protesting, making speeches and conducting mock trials of the Bush administration.
In response, a counter protest , made up of veterans and others from around the state, has demonstrated their solidarity with the troops and the President.
If it is a criminal offense to spit on police during an arrest (because of HIV.) Then is should also apply to throwing blood ( a body fluid transmits HIV - so blood is a body fluid.) It is disgusting and a replay of the antiwar sediment from Vet Nam. I remember the flower Brats in Phil Airport in 1966 spitting on me because I was wearing a Uniform of the USAF. Being called a Commie bus driver this was mild to other thing I was called that can not be said here. Just let your imagination run wild and it will cover what was said. I hope the PUNKS get the max the law permits.
PS: Changed to Civies and never traveled again in uniform on any civilian transport after that. If you confronted them you went to jail and not them. Time changes by history repeats.

Don

I don't know, but they're convinced that they are fully within their rights to do the actions mentioned, but should someone splash them with blood heaven forbid.
Cover the St. Patricks Day Four" with leeches. Head to toe. Worms should stick together.
Follow-up headline should read: Soldier opens a huge can of whup*** on war protestor.
I have talked to dozens of Veterans both of the Iraq Wars and Viet Nam.
They and we are determined to have out Military come back to the USA...Their own country that they are defending...with HONOR!
We will NOT stand for them getting spit upon again!
What a cowardly act this person did to those that make it possible for them to even exist. Ingrates.
It makes me sick what our military and police have to go through in THIS country.
These are acts of criminally insane lunatics who would have been locked up to protect society before the LBJ years.
Blood samples should be diagnosed to see if these maggots have any communicable diseases that could have been spread with their illegal blood throwing.
If they had HIV, Hepatitis or some other leftwing self inflicted lifestyle disease, they should go to jail for assault with a deadly weapon and charges should range from assault to attempted murder.
If these clowns were paid to do this by some $oreA$$ phoney non profit, the board members and directors of the phoney non profit need to go jail and lose everything they own in civil court to this young warrior.
Thanks for the ping. Please read my reply above.
Say WHAT?????
You were over there bombing commies, so they called you a commie? What had they been smoking?
"This is your brain ... this is your brain on drugs ... any questions?"
Send these fruits and nuts to PRISON!
Let's see how their peace protest antics go with the general population in prison. People in prison aren't generally full of love and peace.
Is it criminal to spit on police while not under arrest?
Please put me on a ping list for updates on this story.
If it's not illegal to do this, then it should be okay for all Vietnam Vets to go ahead and piss on Jane Fonda now, rather than waiting to piss on her grave.
What charges were going to be brought against the vet who spit on her at the booksigning???? (that she so magnanimously delined to press.)
I am no commie. Any questions?
If weirdos thow their blood on my, I may as well spill a lot more of it. In for a penny, in for a pound, I say....
Don't know about not under arrest. But during the arrest you bought the farm if you did it. Don't know the term only remember hearing about it awhile back.
Yes. The one I already asked ...
What was wrong with those idiots? Really.
I expect hippies to insult military personnel. It's what they do.
But to call a guy a commie, who's been "over there" fighting commies, is just stupid. It's stupid beyond the stupidity I normally expect from hippies.
So, I ask again: "What were they smoking?"
