September 21, 2005 -- The embattled Gloria Wise Boys & Girls Club in The Bronx — under investigation for taking $875,000 from programs for kids to help fund the start-up of Air America radio — was booted yesterday from the Boys & Girls Clubs of America. The national board of the Boys & Girls Clubs voted to yank Gloria Wise's charter, barring them from using the much-heralded organization's symbols and fund-raising clout because of a breach of ethical standards and failing to file audits.

Evan McElroy, a spokesman for the national organization, said officers at Gloria Wise had ignored repeated requests to file annual financial reports. "We gave them plenty of chances," he said.

"Our clubs are run according to ethical business practices that were, in the view of our board, breached," McElroy said of the Gloria Wise club based in Co-op City

This could draw some real blood, particularly with the IRS. Since Gloria Wise was chartered by the Boys & Girls Clubs of America, there's a good chance its 501(c)(3) tax exemption came under a group exemption letter issued by the IRS to the Boys & Girls Clubs of America and their individual clubs. This is a common practice with 501(c)(3) public charities.

One of the most important things such a letter does is eliminate the need for each individual chapter of a national 501(c)(3) organization to obtain its own tax exemption. Thus, if a national organization revokes a local chapter's charter, that chapter also loses its Federal income tax exemption and has to apply for a brand new one. The application process, which is confidential under IRS regulations, involves disclosing basically all of its finances to the IRS.

Given the amount of skulduggery that's occurred between Gloria Wise officials and Air America's principals, particularly the embezzlement of the $875,000 for a non-exempt purpose, it's very unlikely that Gloria Wise could get a 501(c)(3) exemption on its own. This charter revocation could, and should, set off an IRS criminal audit of Air America, Gloria Wise and all the individuals involved with them in the embezzlement.

Great analysis! I doubt these ding dongs have been following the 501(c)(3), and other tax rules anyway. More likely than not, they have been abusing funds UN-style, protected by the auspices of the tax exemption. I predict that if the IRS attempts an audit, they will find a giant rat's nest.

I found it suspicious that a charity would have over $800k in cash to loan to another organization. Shouldn't they have been using that money to help somebody, anybody? I can understand temporary cash balances, but this seems too much. Perhaps someone who is more familiar with how these charities work can explain it to me.
