Those members of the Vermont state Legislature who voted to approve same-sex civil unions are now faced with a consequence that should merit every one of them being voted into retirement.

The New York Times devoted half a page to reporting from Vermont's state capital of Montpelier:

Judges in Vermont and Virginia have different ideas about what is best for Isabella Miller-Jenkins, 3, born to a woman who had a civil union with another woman in Vermont. The relationship ended two years ago. Now each woman says Isabella is her daughter, with one asserting exclusive motherhood.

The judge in Vermont ruled that the women should "be treated no differently than a husband and wife."

Your honor: What on earth does this mean? – other than an astounding conclusion that there is no difference between a man and a woman – and no difference between traditional marriage and sodomist civil unions?

This Vermont judge established a visiting schedule and held the biological mother, Lisa Miller, in contempt of court when she failed to comply with it.

The judge in Virginia ruled that Ms. Miller had the sole right to decide who could see the child. He ruled that the former partner, Janet Miller-Jenkins, had no "parentage or visitation rights."

Legal experts say the decisions, which reached State Supreme Court here on Wednesday, are the first to present a direct conflict between two state courts on a substantial legal question arising from a same-sex couple's union. The decisions offer a preview, the experts added, of what are quite likely to be many similar conflicts around the nation.

Ms. Miller moved back to Virginia, where Isabella was born, in September 2003. The couple had visited Vermont briefly for the civil-union ceremony in 2000 and lived there for more than a year after Isabella was born in 2002.

And speaking of "conflicts around the nation," Ms. Miller-Jenkins told the Times of a new and equally serious development – aside from the fact that her former, but now apparently divorced, lesbian civilly-unioned lover is no longer so united to her: "When I left Janet, I left the homosexual lifestyle and drew closer to God."

Is the state of Virginia possibly going to let anybody – or any court from Vermont – try to seize this 3-year-old, so that in direct opposition to her real mother's religious belief, this little girl will be subjected to visitation rights? Not from a father, mind you, but from the former lesbian lover, whom her reformed and converted real mother has abandoned, and whose lifestyle is religiously repugnant?

This is why we need a Constitutional Amendment to either define marriage as one man and one woman or reject it entirely. We now have a case where the laws of one state contradicts that of another. AT THE EXPENSE OF THE CHILD !

If a woman had a relationship with a man who was not the biological father of her child, would the boyfriend get visitation rights of said child?

Choosing to lead an alternative lifestyle and then choosing to pretend to be a normal person within the perverted relationship is creating a miserable life and future for the child created by the ACLU.

Just wait until the taxpayer and liberal foundations supported ACLU gets a hold of this. This child will wish she was never born.

This article does not make it clear why there is a difference of opinion in the courts. The states have to decide which is a convenient forum, and the other has to butt out.
It sounds like Virginia is the home state of the child in question, from this little bit of reporting, so I wonder what Vermont's say so is, other than a bit of politicking.

Proponents of same-sex unions are looking through the wrong end of the binoculars. This particular case is the best case in point to describe the fact that unions are not about adults and their needs. They are about the creation of and the protection of Life. Same sex unions create a sub-class or a second-tier group of citizens (children) who are deprived of their full complement of human and civil rights by intentionally denying them access to both a male or female parent. The key words are "by intention". It doesn't matter how many social workers or test tubes you pass them through, they are still a second-tier citizen. I thought that we had laws about ths in other arenas. Why not here?

Through the mists of time I remember an old rock and roll song (was it the Mothers of Invention or the Fugs?) with the refrain "It Can't Happen Here".

But it will, if we don't stop it. This is Theater of the Absurd in real life. Reality exists, right and wrong exist, natural laws exist, and lives of children (and adults) can really become destroyed. Especially children, whose early years, if twisted by scenes like this, can be scarred for life.

It disgusts and saddens me that homosexuals will use children as pawns to prop uf the fantasy that their lives are normal and natural. Better to face reality, and the truth is that there is a way out of the "gay" life.

I'm not sure if it would make any difference if the boyfriend claimed rights due to common law marriage. But as just a boyfriend, I would say no.
