Mom wants God in pledge, backs Roberts

WASHINGTON (AP) - The former lover of Pledge of Allegiance challenger Michael Newdow is again fighting to keep the words "under God" in the pledge.

Sandra Banning and Newdow, an atheist, are the unmarried parents of the elementary school-aged daughter Newdow sued on behalf of three years ago when he challenged the pledge.

A San Francisco federal appeals court in 2002 agreed that it was an unconstitutional endorsement of religion for public school children to recite the pledge because it includes the words "under God."

After the court ruled, Banning challenged Newdow's standing to sue, saying he did not have custody of their daughter when he sued. The Supreme Court agreed and tossed the case last year without ruling on the merits.

Newdow, a doctor and lawyer, refiled the suit on behalf of other Sacramento-area parents and won in U.S. District Court in Sacramento on Wednesday.

That prompted Banning to go to Washington on Thursday to publicly support the confirmation of Supreme Court chief justice nominee John Roberts, in anticipation he would rule against Newdow if the case reaches the Supreme Court again.

She also said she was creating the "One Nation Under God Foundation," a group affiliated with the conservative Traditional Values Coalition.

"It is critical that judges such as Judge Roberts be on the Supreme Court bench when the case is heard," Banning said at a news conference.

Even Schumer, on O'Reilly last night, said that this judge made a bad ruling.

Mom and daughter go to Calvary Chapel...good to see her backing Roberts.

More and more optimistic about Roberts...

Glad she's spoken out.

At the Prayer Service in the Washington Cathedral today one of the preachers closed his talk with the words.....'One Nation Under God'.

From what I understand she is being raised by the mother, is a practicing Christian and loves to say the pledge. I don't know how much Newdow sees her but it sounds like the mother is doing a good job.

Still, who needs this as a kid?

He only said that because he knows the ruling will be overturned , and the left can't afford to keep alienating the christian base.

As I understand the Sac Federal judge's ruling, he said he had no other choice but to reimpose the ban based upon the 9th Circus' earlier decision (someone correct me if I'm wrong). The fact that the USSC didn't take the issue head-on, but only threw out Newdow's earlier challenge because he didn't have standing, the 9th Circuit's decision was left standing. The new Roberts Court (hopefully after a 2nd Bush appointee takes the bench) needs to take up the issue and decide this once and for all.

tell me something newdow... have you ever used cash? if so, i think everyone who has ever engaged in a cash transaction with you, should sue you for unconstitutional endorsement of religion by receiving or dispersing these funds that all say "in God we trust".

I heard the mother in an interview - they were not married. She said when they were involved he was obsessed with getting "In God We Trust" removed from our currency.

The argument that the judge made, that essentially says that children in a classroom who are not even required to state the pledge, but to simply LISTEN to it, creates a coercive environment and thereby establishes religious perspective upon the children.

OK..how about this.

Children today, are FORCED to take tests that DEMAND them to answer questions on the creation of the universe to affirm evolution or fail their class. This constitutes a similar, in fact, more coercive environment upon those children to accept religiously held believe in evolutionary creation.

I wonder if one of their parents should sue?

It's all about him. He could care less about his daughter. I do believe that when she is older she'll want nothing to do with him. The sad part is that he will care less.
