I think this judge should be made to observe this procedure
at close range. She might change her mind after she tosses
her cookies.

I wasn't aware that infanticide was constitutional.

You know what he thinks, but he can't tell you.

Either he's a godsend or the son of Satan... face it.

Tx, who was your next pick Owen?

I second that! Janice Rodgers Brown is the one I'm pushing for. Of course, Priscilla Owen and some others would be great, too.

Hopefully, a five vote majority of Scalia, Thomas, Roberts, Kennedy, and (fill in the blank - perhaps Brown) will reverse this awful ruling.

What a biased headline. "Judge: Michigan law against *type of abortion* unconstitutional"? That's even worse than the usual "certain type of late-term abortion" that weenie liberals use because they refuse to use the more descriptive "partial-birth abortion." Pretty soon, liberals won't even use the word "abortion" (NARAL already paved the way) and the headline when a judge strikes down a PBA ban will read "Judge: Michigan law against *type of emergency contraception* unconstitutional." (Has anybody else noticed how the media now uses the phrase "emergency contraception" as a synonym for abortion?)

Every Democrat should be allowed free, unlimited abortions and sterilizations

Why do you think democRATS are losing all the elections now. They have aborted over 43 million voters.

I really does boil down to the indoctrination at law schools. This judge is just typical of the liberal lunacy that infects the legal establishment heirarchy.

Liberals dominate the manatory bars and the judicial associations.

This Judge is literally trying to PRE-empt legislation per the article. Not only this procedure but ANY procedure can not be stopped.

I also want President Bush to nominate Judge Brown to the Supreme Court (she was my first choice when Bush chose Roberts).

For the record, her name is spelled Janice *Rogers* (without the "d") Brown.

I can only go on what others say...I don't really remember Owens hearing as much as I do Janice Rogers Brown's...

I keep hearing that Michael Luttig would be the most bona fide conservative...but that Bush will probably be pushed into choosing a woman or an hispanic...

I THINK...Janice Rogers Brown...I have read some of her speeches....but, I will go back a check out Priscilla Owens..

I have also heard Edith Jones's name...do you know anything about her?

This is incredible. Apparently this judge (and many more) cares nothing about the testimony given by the guy soon to become our new Chief Justice. Or about life itself.

Gee, is there no implied right to LIFE present in the Constitution???

Don't count on Justice Kennedy voting to overturn this ruling. He's as wishy-washy as they come.

But if Justice Stevens retires in the next 3 years, President Bush can name a 5th conservative to the Court and then Roe v. Wade (and all its progeny) will be overturned once and for all.

Partial Birth Abortion Ban is due to come up before the US Supreme Court shortly... I don't know if it is in the October session and if Bush can get another Justice on the court...

I don't count on Stevens (or any other justice) retiring in the next three years. My $ says the only way W gets a third appointment is if one of the remaining justices assumes room temperature well before the 2008 election. I would LOVE to be wrong, however.

Kennedy's deteriorating pretty fast, but he did vote to uphold Nebraska's law against partial birth abortion last year. It was struck down 5-4, with O'Connor voting with the four ultra-lefties. I'm also a little hopeful that Roberts will be able to pull Kennedy to the right a little. On the other hand, Kennedy may pull an O'Connor and move even further leftward.

Apparently, the right to abortion is a super right, superior to all other rights - the right to life, liberty, and the pursuit of happiness, the right to free speech, the right to peaceably assemble, etc.

Woe to the judges.
