Don't count on Justice Kennedy voting to overturn this ruling. He's as wishy-washy as they come.

But if Justice Stevens retires in the next 3 years, President Bush can name a 5th conservative to the Court and then Roe v. Wade (and all its progeny) will be overturned once and for all.

I don't count on Stevens (or any other justice) retiring in the next three years. My $ says the only way W gets a third appointment is if one of the remaining justices assumes room temperature well before the 2008 election. I would LOVE to be wrong, however.

Kennedy's deteriorating pretty fast, but he did vote to uphold Nebraska's law against partial birth abortion last year. It was struck down 5-4, with O'Connor voting with the four ultra-lefties. I'm also a little hopeful that Roberts will be able to pull Kennedy to the right a little. On the other hand, Kennedy may pull an O'Connor and move even further leftward.
