Prosecutor Calls Inmate's Death 'Poetic Justice'

MICHIGAN CITY, Ind. -- The prosecutor who sent a man to prison for murdering a 10-year-old boy says the inmate's death after a prison fight is "poetic justice."
Twenty-three-year-old Jason Patrick of South Bend was injured in a fight at the Indiana State Prison in Michigan City. He died Monday at an Indianapolis hospital.
The Marion County Coroner's Office and the Indiana State Police are investigating his death.
Former St. Joseph County prosecutor Scott Duerring said Patrick should have been sentenced to death in the slaying of Evan Parker.
The boy was visiting South Bend with his mother from Alabama in July 2002. He was found severely beaten and stabbed in a basement of a house.
A judge ruled that Patrick couldn't be executed because he was mentally retarded.

I'd have no problem with a private citizen saying that, but for a public servant - a prosecutor, no less - to do so flies in the face of the rule of law.
