Burger chain to pay $34,000 after not hiring disfigured worker

KANSAS CITY, Mo. -- Hardee's has agreed to pay $34,000 to settle a lawsuit alleging that one of its restaurants repeatedly refused to hire an applicant because her face was disfigured.

The U.S. Equal Employment Opportunity Commission and the St. Louis-based fast-food chain, which is owned by CKE Restaurants Inc., submitted the proposed agreement Monday to U.S. District Court in Kansas City. Besides the money, the settlement also calls for the chain to apologize in writing and further train its managers and human resources employees.

The EEOC said the suit, also filed Monday, alleged that the job seeker applied more than once for entry-level work at the Hardee's in Oak Grove, near Independence, but was never hired. The suit said others with no better qualifications were given jobs while the applicant was not. The woman has Treacher Collins Syndrome, a birth defect that caused a malformed cranial bone structure, asymmetrical eye placement and the absence of ears.

CKE, based in Carpinteria, Calif., did not return calls for comment.

I remember when I worked at a job handling cash. We were always asking the customers if they had a penny or two to round off the change.

Then again, this was at a computer retail/service shop and everyone who worked there was a geek or an obsessive compulsive with a distaste for handing out change that included pennies (often to the point of digging into our own pockets for spare change).

Then again, this was at a computer retail/service shop and everyone who worked there was a geek or an obsessive compulsive with a distaste for handing out change that included pennies (often to the point of digging into our own pockets for spare change).

It wasn't laughed out of court ---- the EEOC won, and it went to the U.S. Supreme Court before getting reversed!

(As the owner of a 500+ employee company, I'm up on these things.)

Wow, I didn't know that. I remember Hooters running an ad with a really hairy-chested guy dressed up in a Hooters outfit saying "Hi, I'm Vinny and I'll be your waitress" to make fun of the EEOC. It was hilarious.

When I go into Hardee's or some such place, I don't want education or understanding or a Dr. Phil session. I want to get my food fast without thinking too much about it, then eat it in peace. It is perfectly reasonable for a restaurant to hire front-desk help that looks relatively normal. Most people would definitely avoid any joint where they are likely to meet Quasimodo at the counter.

EEOC drops Hooters sex-discrimination probe

WASHINGTON (CNN) -- A federal agency has ended its four-year sexual-discrimination probe of the Hooters restaurant chain that sought to force the chain to hire waiters and not just waitresses.

A spokesman for Rep. Harris Fawell, R-Illinois, chairman of a House subcommittee on employment, said Fawell received a letter from the Equal Employment Opportunity Commission (EEOC) saying it had ended its investigation.

The chain did, AFAIK, settle a privately-filed lawsuit.

That's what I had thought, although I can't say I followed the case all that closely. The whole situation struck me as a good reason to close the EEOC down entirely. If the worst example of discrimination they could find was Hooters that means the USA must be an egalitarian paradise.

I dont think I would be able to order from her and or eat after ordering after I saw her. I know it sounds cruel but its a reality for me. Surely there is a more appropriate place for this girl to work then a food eatery.

true 7-11 story

Total is 3.05, I put down a fiver and start digging for a nickel, meanwhile the kid starts entering the $5 into the register, I pull out a nickel and put it down. By this time the register has alreay calculated my change and he has no idea what to do, I tell him no I gave a nickel I don't want all that change just give me 2 bucks. He looked at me as if I was trying to cheat him and said too late he already rang it up. I grab my nickel and he gives me my change, I put down the .95 and hold up the other .05 add it to the pile and ask to change this for a dollar. Well that's against store policy!!! I could have strangeled the kid (probably should have.)
