"No one will be able to be armed. We are going to take all the weapons," Riley said.

Well, that's chilling. I'm not a law expert but frankly I did not know they (meaning cops & government) could do this as long as the guns were legal. I had no idea.

If ordered by a mayor -would you seize guns?

No. I'd have no part of it. Not sure how I'd keep my job on something like this. "Job stress" due to an incompetenet mayor making up the rules as he plays along and flouting the actual laws mighr be the only way out. Or conveniently miss a few guns here and there.

"Any guns?"

Yes officer."

(wink wink)"That you want to keep?"

"What guns. Me?"

Have a nice day sir/maam.

Would you remove people from their houses?

Are they on fire or are the people or person in such a state they can't fend for themselves? Even then if they wanted to stay thats their business. Theres folks that need actual help so why waste time here? I think one thing I'd want is some sort of "hold harmless" wording somewhere in the event something happens to those who remain behind. I'd hate to be named in a lawsuit because after they were given the option to leave and something unforeseen happened to them. Just a thought

It seems under the circumstances, the NOPD officers who are missing are doing the town a bigger service at this point as far as the laws are concerned. God be with the one's who are no longer with us and their families.

Thank You that give me some faith in authority. The people I see on TV are destroying what is left.

Actually, if you want to be hyper-technical, the 2A (like the entire Bill of Rights) applies only to the Federal Government.

Actually, as you claim to be a law student, you should know that the Constitution is the supreme law of the land, and that all of its Amendments apply to all levels of government in the USA.

It is only through the incorporation clause of the 14A that any of the Bill of Rights applies to the States.

Simply not true. 'Incorporation' is a legal concept invented by the USSC to give it more power. All of our rights are inalienable, and no level of any government has ever had the power to infringe upon them.

Only those rights "fundamental to the concept of ordered liberty" are incorporated.

Our right to arms is not "fundamental to the concept of ordered liberty"? -- Hogwash. Hard to believe you've been taught that in law school.

Once again, it is hornbook law that States have broader police powers than the Fed. gov't.

Broader yes, but this does not give them power to infringe on our liberties.

The fact that the State of Louisiana ordered the surrender of firearms in an area where law and order completely broke down doesn't bother me. It may be unwise, but it is 100% legal.

Dream on that its 'legal'. But tell us, how can you dream of order in an area where your peers lack the tools to secure order?

I will reiterate: the death toll will be far, far lower than the media is spinning it to be.

I suspect you are right. The "tens of thousands" of corpses would be evident by now, if they existed. It is looking like some number of hundreds, maybe, not thousands. I'm sure the media will be quite disappointed as their body-hunting cameramen come back empty-handed.

Under what legal authority is this being done?"

Under the authority that if you resist, the whole weight of the law? will come down on you and if they kill you, nothing will happen to them and people on this forum will say you deserved it.

What is the first word of the First Amendment? To whom would it apply, absent the Fourteenth?

What are the last four words of the Second Amendment? (1) Is there anything in that Amendment that limits is scope; (2) even if there were, is there any reason to believe the Fourteenth does not extend to it?

Note that the Thirteenth Amendment explicitly allows convicted felons to be branded slaves, and a reading of the Second as applying to "All Free Persons" would thus not apply to them (I don't think even the most hardcore Second Amendment supporter would argue that slaves at the time of ratification were to be freed thereby).

"Whatever happened to the concept of citizens being the allies of the law?", you ask. We're reaping what we're sowing.

Here's the formula for serfdom and cultural mayhem:
Welfare state mentality + publik skool teaching (baseless self esteem + Darwinism + Malthusian & Gramscian social engineering) + political correctness + post-modernism - Christian worldview and morality

Based on the secular postmodern worldview, what would respect for the law be based on now? Essentially "God is dead", so there is no law giver, nor is man any longer created in the image and likeness of Him, therefore requiring obedience and self restraint reflective of His character. Everything is up for personal interpretation. It will increasingly be that only "might is right".

I agree they are not doing it in Biloxi, but Biloxi did not have a follow on flood AND Biloxi was better handled. That's a fact.

Nonetheless, I have trouble with the confiscation of weapons. I don't accept Jude's notion that the citizen has a federal right to a gun but not a state right.

I guess I'll just let everyone know that's my federal rifle to go with my Federal slugs! :>)

Even if might doesn't equal right, might equals survival.

Joe Brower also has a gun rights ping list, beyond Mr. Mojo's excellent armed citizen one. Also, just hit the banglist and/or bang_list keywords.

Sorry, the quote sounds good on paper, but life is more than merely surviving. The Bible and thousands of Christian martyrs attest to it.

People should always be prepared to defend themselves against those that intend them harm. Oppose evil, because right, meaning God's truth, does matter. Effectively standing up for God's truth will not necessarily be of our might, but of courage, even surrender, and it just might mean you won't be left.
