By DEBORAH ORIN
September 7, 2005
WASHINGTON The feds yesterday recommended that former Clinton National Security Adviser Sandy Berger get at least a year's probation and do community service but no jail time for stealing top-secret memos and lying about it.
Berger pleaded guilty last April to taking the documents and reportedly hiding them in his pants and socks from the National Archives while vetting them to refresh his memory before testifying before the 9/11 commission.
He's to be sentenced tomorrow.
The memos were versions of a report that Berger ordered on the millennium bombing plot. ...

Berger should do time. Serious time....especially since it is, prima facie, obstruction of justice...

How long a sentence would any of us get for theft and destruction of classified federal documents? Anyone, anyone, Buhler?

Berger should do time. Serious time. There were people here, claiming to be in the know that assured that the judge wouldnt accept whatever-plea he made and that hed be punished suitably.
It has been a long time and most have forgotten, I guess. And, of course, there are bigger events in the news nowadays

I'm lighting a candle in hope that the Judge throws out the U.S Attorney's recommendation.

and do community service Clean up New Orleans with a toothbrush ... and not one of those fancy electric ones.
I still want to know what documents he destroyed and why he destroyed those copies of them. Who had what notes written in the margins and who told him to destroy those documents?

There were also people here suggesting that he could be a fount of information about his real purpose and all he really took. They argued that his cooperation would influence his sentencing and that was why the sentencing was so delayed. I have no idea whether they were right.

One more thing.
You don't "surrender your security clearance".
DSS yanks it away from you like a stolen piece of candy from a toddler.
And once they've done that, there's almost never any getting it back.

Far more amazing than the non-execution of Berger, and the lack of even a token amount of jail time, is the fact that he will
REGAIN his national security clearance in three years!!!
He'll need bigger socks next time he's allowed access to our nation's most classified documents. If Hillary's the president, he can just show up with a dump truck for his haul.
