The military has said they won't force anyone out.

As many as 2/3 of Nagin's police force walked away from the job, and he's letting the remaining force go to Vegas, 1/2 at a time, for a week.

So, who's gonna enforce this?

The military cannot enforce this unless the Governor specifically requests it. At least that is my understanding of how this works.

Military says that isn't their responsibilty.

Governor says she hasn't issued that order.

Looks like the mayor is going to do it with his police force -- once they return from their paid vacations to Vegas.

The military won't participate because this is a law enforcement function. I'm afraid many people don't understand what authority the military has (or lacks) to do things like this. Just like the military can only shoot in self-defense, the soldiers don't have the authority to remove people.

Sad, but true.

Wait, I've got it figured out. For all the reasons several of of have already mentioned, including my post #11, Nagin feels free to issue this ruling BECAUSE he knows it won't be enforced. It's a safe move for him, and he knows the chances of some stupid officer shooting a defenseless homeowner are very low, maybe even zero.

That's his motivation, a safe decision.
