Lumberton OKs road's location close to house
LUMBERTON - In a unanimous 7-0 vote Monday night, the Lumberton City Council approved the proposed location of a connector road that, when built, will run within 50 feet of a paralyzed man's bedroom. "The action plan we passed tonight is part of the design to connect subdivisions to subdivisions in accordance with a city ordinance," Surratt said. "It will help move traffic east to west in our city...." There are four choices now for drivers
"He may not get to go boating or fishing. That's his piece of land," Linda Rich said. "That's his little playground."

Except if you click on the story, you learn that the road will go through a vacant lot he owns next door to his house. Would you prefer that connector roads be built through other folks houses rather than this guy's vacant lot?
Even under a narrow reading of the Constitution, taking land for roads is generally seen as a legitimate use of eminent domain.
I would agree that the city should never have approved the subdivision plats without adequate access roadways, but some FReepers would say that that would unduly burden the landowner's rights to use his property. If you take that position, then you have to use the taking clause to clean up the mess later.

When they built the railroad by the Merrimac it went 14 feet from Daniel Webster's house. He never complained, viewing it as progress.

I am not a little disturbed by the responces I received here. To answer your queries. There are fewer than more houses that have roads within 50 feet of their bedrooms. I would venture to say none of these people are paralyzed from the neck down. Johns house is a very big house, which sits in the center of the three lots. It's not a vacant lot next door. Trying to push an agenda? Amazing. As a matter of fact I am a conservative republican in the deep south of Texas and I am a christian. I was looking up some way to help my friend when I found this site. A note to the moderator. I did not know the rules of posting an article.. dont change the article or something like that? I didn't change a single fact of the matter though. I don't believe that a city ordinance should be reason enough or used to take someones property. Thank you all for your posts. I wish you could all actually see where he lives and make a judgment call then. If your still reading this, here is a little miracle that happened yesterday here/
We are in constant service to the thousands of evacuees from Louisiana here in Southeast Texas. Last week volunteers from Cathedral in the Pines were asked to bring hot casseroles to the Salvation Army to feed over 100 evacuees. 43 casseroles were committed to. Less than 80 people came to the dinner, but after everyone had their fill, the volunteers put 42 leftover casseroles in the freezer. They were puzzled how there could be so many left over. At 2AM busses pulled in from Louisiana with over 200 evacuees that had been standing on a bridge for 4 days with no food. The left over casseroles were heated and all were fed with no shortage of a hot meal.
These were regular family size casseroles guys, let's do the math........
