Dear Mr. Riley:

It was with great dismay that I read recently of WHEDA's new practice of requiring only Individual Taxpayer Identification Numbers (ITINs) when applying for home mortgages. The IRS assigns ITINs to individuals who cannot obtain Social Security numbers. It is well known that the vast majority of ITINs are given to illegal aliens. The shift from requiring Social Security numbers to requiring ITINs is apparently aimed at aiding illegal aliens in purchasing homes.

Mr. Riley, I remind you that it is a clear violation of federal law to aid illegal aliens in staying in the United States. 8 USC 1324(a)(1)(A)(iii-iv) reads in part that it is illegal and punishable by a fine and imprisonment to "conceal, harbor, or shield from detection" an alien or "encourage[] or induce[] an alien to come to, enter, or reside in the United States." There is almost no other more direct way to encourage an alien to stay than helping him purchase a home.

I understand that while WHEDA is not a government agency, it secures loans with below-market interest rates due to its affiliation with the state of Wisconsin. The consequences of WHEDA's relationship with Wisconsin are dire. By assisting WHEDA in offering these privileged loans to illegal aliens, Wisconsin is obstructing the Immigration and Customs Enforcement's work in tracking illegal aliens. After all, if illegal aliens were required to submit Social Security numbers on their loan applications, fraudulent numbers could be properly reported to ICE.

Obstructing the work of immigration officials has violated the plain meaning of federal law for nearly a decade: "a Federal, State, or local government entity or official may not prohibit or in any way restrict any government entity or official from sending to or receiving ... information regarding the citizenship or immigration status, lawful or unlawful, of any individual."

WHEDA's new practice encourages aliens to come illegally into the United States and, once here, it provides them with privileged loans not enjoyed by many legal residents. In so doing, it obstructs federal law enforcement's efforts to stop and track illegal aliens, and it mocks the millions of residents and citizens who got here the right way. I strongly urge you to reverse WHEDA's application policy immediately.

WHEDA's new practice encourages aliens to come illegally into the United States and, once here, it provides them with privileged loans not enjoyed by many legal residents.

Sometimes with this type of issues that are obviously stupid, it's good to think about Mr. Tancredo becoming the next President of the United States... it seems to be that he's the only gov't. officials if not one of the few who keeps on running after illegals... wonder what is, with all due respect, our President George Bush is doing about this issue.
