DAYTONA BEACH, Fla. -- A landmark decision has been made in the fight for the Daytona Beach boardwalk.
Late Friday afternoon, a judge ruled that the city had the right to take away property from three business owners. They were holding out from a developer that wants to turn the area into condos and hotels.
However, the judge also decided that the developer will have to pay two or three times the amount he originally offered for the properties.
The judge believes tearing down the old properties and redeveloping falls under the area of "public use."

That's a shame. There's a funky place to get oysters there that's awesome.

I have two problems with your concern/argument. #1, you ask who owns the ocean view. Well, no one, but someone in this case owned the land/boardwalk on their property, which went to the ocean. Who has the right to say the "public good" is to remove the board walk for a condo. #2. In most states there is a "Public Easement" along the beaches up to mean high tide. So, NOBODY can build right down into the water (or over it). Florida needs to get with that program.
I think you are right-something tells me that this land grabbing stuff will be the spark that ignites a conflagration I'd hoped could be avoided in this country.

It's already there dude. This travesty of the 'taking' of this property has nothing to do with public access. There will always be public access regardless of what is developed there. I've developed both town homes and condos on the beach in Florida. BELIEVE ME these laws are on the books.
This is about eminent domain! I must have missed the invitation to the bash Florida for everything party!
