2 Illegal Immigrants Win Arizona Ranch in Court (Judicial Tyranny IV)
N Y TIMES ^ | AUGUST 19, 2005 | ANDREW POLLACK

Posted on 08/19/2005 2:19:28 PM PDT by radar101

A few months ago, this ranch was known as Camp Thunderbird, the headquarters of a paramilitary group that promised to use force to keep illegal immigrants from sneaking across the border with Mexico.

Now, the 70-acre property about two miles from the border is being given to two immigrants whom the group caught trying to enter the United States illegally.

The land transfer is being made to satisfy judgments in a lawsuit in which the immigrants had said that Casey Nethercott, the owner of the ranch and a former leader of the vigilante group Ranch Rescue, had harmed them.

"Certainly it's poetic justice that these undocumented workers own this land," said Morris S. Dees Jr., co-founder and chief trial counsel of the Southern Poverty Law Center in Montgomery, Ala., which represented the immigrants in their lawsuit.

Mr. Dees said the loss of the ranch would "send a pretty important message to those who come to the border to use violence."

Mr. Mancía, who lives in Los Angeles, and Ms. Leiva, who lives in the Dallas area, have applied for visas that are available to immigrants who are the victims of certain crimes and who cooperate with the authorities, Ms. Bruner said.

Mr. Mancía and Ms. Leiva were caught on a ranch in Hebbronville, Tex., in March 2003 by Mr. Nethercott and other members of Ranch Rescue. The two immigrants later accused Mr. Nethercott of threatening them and of hitting Mr. Mancía with a pistol, charges that Mr. Nethercott denied. The immigrants also said the group gave them cookies, water and a blanket and let them go after an hour or so. The immigrants said the ordeal, in which they feared that they would be killed by the men they thought were soldiers, had left them with post-traumatic stress.

So why did he join up, and why did he turn into a loose cannon--unless he was under orders to do so?

I would agree that the overall roadmap could lead to a conclusion like this. But there has to be a Quid Pro Quo; what would he get out of it?

The history of protest in the '60s shows that indeed, the federal government instigates much that it supposedly abhors. I still think about the guy who started a lot of the rioting in Chicago in '68, who apparently egged on Jerry Rubin, and is generally featured looking like a dork in a picture with a ludicrous hat with horns - kinda like what the newspaper editors of the time thought a "freak" should look like! He was the FBI's guy. Basically an entrapment artist.

But he was an actual agent; I suspect there were a number in Ranch Rescue, not ex-cons like Nethercott.

So I'm just not convinced that it was Nethercott. His actions seem too stupid. Unless there's a nice, fat account in the Cayman's to pay him back for the lost dirt. Speaking of which, it is interesting that he paid for that in cash, if the accounts are to be believed.

"If I hit a bank robber with a bat while he is leaving the bank, can he take my house?"

Actually yes. I seem to remeber a case in NY I think, where a taxi driver pinned a would be robber to a wall with his taxi, breaking the thiefs legs, the thief sued and got a whopper of a judgement. Also a couple years ago in WA State, a man who was burglarizing houses was caught in the act by a K-9 Unit. The guy tried to run, the cop told him to stop. The guy continued to run so the cop released the dog. The dog bit off part of the guys foot, he sued Snohomish Co. and won $450,000.00.

Morris Dees is a special kind of fool if he really thinks this sort of
thing will have any effect on the movement or the participation of
people in it. More than that, I think he may eventually regret having
done this and won. His brand of hatred of Americans is no longer
popular, no longer acceptable or even safe.

Your leaving out that the American attacked the two illegals with the butt of the gun.

That is why he was sued and got the judgement against him and lost his Charles Manson retreat.

Why do you keep repeating this? He was found not guilty of this alleged assault

http://www.kpho.com/Global/story.asp?S=1924785

Even if he DID, these individuals invaded his property, he has the right to protect it-- unless of course you're against that sort of thing?

I'm not leaving anything out.

The jury deadlocked on the assault charge in the criminal case.

Assault was alleged and found by default in the civil case, which is not the same thing as a finding made in an adversarial setting.

If you want to personally believe the defendant pistol-whipped them, fine. That doesn't mean it happened.

The Arizona legislature could and probably should pass legislation that limits or otherwise disable suits of this nature brought by illegal aliens.

And did he do this in Mexico? Just where was the "alleged assault" (that he was found not guilty of, btw)?

So, can I come into your house, and trash/take what I want, and when you attack me, I'll sue you and get all you own...sound fair/reasonable?

I can smell the fabric softener on you from here...might wanna lay off the stuff.

I was not there when this happen but have been put in similar situations when encountering(the new pharse)"ENTRANTS".I and other people and groups carry cameras,so we can film these whatever,There's actually been accounts of these people hitting themselves with rocks and claming they were beat up when the BP arrived, then you have to play back the video for them to show them we didn't abuse them and to be fair to the BP almost all of them have been thankful for the help. The other agencys or the alphabet soup guys i can't say the same about and try to stay away from.I came in after this occurred and have been trying to do damage control, with some success, the death threats are down from what i used to get,in fact after this was announced i have only received two negative emails and alot more supportive ones, and maybe in the longrun this will help wake people up.Anybody that lives on the border is allready well informed and in someway or another has been affected by this open border policy

Nethercott was phony he clamied to be in the military, his DD214's show he never got done with boot and was given a mental dischage after 3weeks,he was supposed to have got the money by a law suit to buy the ranch,After this time alot of stuff started to happen,J Foote moved RR on to the ranch which led to a fall out with Nethercott and Foote,Foote was arrested on a gun charge from a domestic violence arrest in wyoming in the 90's thanks to Clintons gun act which made anybody ever arrested for domestic violence not allowed to own a gun, part of his OR his that he has nothing to do with RR.if you think i'm a troll that's up to you.I was directed here by Rescuewithout borders.org who is a friend and wanted to say thanks and put my two cents in, if you have any comments or questions you can email me at paul13usa@ranchrescue.com
