Asked why Berger wasn't sentenced as scheduled on Friday, July 8, a Justice Department spokesman told NewsMax on Tuesday that Berger's sentencing has been postponed till September.
The spokesman declined to offer an explanation for the delay.
Repeated calls asking about the postponement to Berger's lawyer, Washington, D.C., attorney Lanny Breuer, went unreturned.
Federal District Court's U.S. Magistrate Deborah Robinson, who is presiding over the Berger case, also did not return a call inquiring about its disposition.
After Justice Department prosecutor Noel Hillman allowed Berger to plead guilty to a misdemeanor, he requested what some consider an extraordinarily light sentence given the gravity of the crime - a $10,000 fine, a three-year suspension of Berger's security clearance and no jail time.
The recommendation for leniency was in stark contrast with the comments of Deputy Attorney General James Comey, who suggested after the document theft story broke that Berger could be headed to jail.

Berger was stealing and destroying top secret documents related to the Clinton's Wall and teh Able-Danger.

I read the other day that Berger paid a $10,000 fine and the matter is settled. If this is the case and I wasn't just reading some misinformation, then the reason they postponed it originally was so they wouldn't have conservatives screaming at them for letting Berger off the hook. They could just wait until our backs were turned and let him out the back door.
Well, the judge can always reject the U.S. Attorney's recommendation. What do the Federal Sentencing Guidelines say about this type of case?
until a leading voice in the administration gets involved in this story - its going nowhere. we can talk about it here, on talk radio, but nothing will be done.

Unless someone else put secret documents having to do with National Security into their underware, I don't believe there has been this "type of case" before.
If the plea is based on misrepresentations, and it is based on false information, the prosecutor can recind the deal.
If the Judge thinks there is more, the judge can reject the deal and ask for more information.

Where did you read that?
If it's true, the only possible thing I can think is that he gave up lots of names and details. But the question is whether these will actually ever be used to get other prosecutions and convictions. Probably not.
