Michael Schiavo Poised To Sue Caregivers
Tampa Bay Online ^ | 8/10/05 | David Sommer

Posted on 08/10/2005 10:38:54 AM PDT by marshmallow

CLEARWATER - Michael Schiavo has asked a court to waive the two-year statute of limitations on filing a medical malpractice lawsuit against one or more of his deceased wife's caregivers.

Terri Schiavo, 41, died March 31 after her feeding tube was removed after a seven-year court battle.

Schiavo's attorney in this case, Mark Perenich, said he was not able to discuss the proposed lawsuit behind Tuesday's request for an extension of the two-year statute of limitations.

By law, medical malpractice lawsuits must be filed within two years of the alleged misconduct unless an extension is granted.

In October 2003, Terri Schiavo's feeding tube was removed on court order. Doctors reinserted it on orders from Gov. Jeb Bush.

You haven't even named your source. I guess that's because you made it up. I told you it was from the Zogby poll that came out right after Terri died. She died March 31, 2005. I think the poll was released a few days later. I don't feel like looking for it. If I come across it, I'll let you know. If another freeper has a link to it, I'm sure they'd be happy to provide it. If that's not good enough, then I suggest you find it yourself.

Paging Hildy, oh Hildy, please report to nicmarlo's post 571. Everytime I read a post from you asserting some falsehood like: Michael didn't spend Terri's money on attorneys trying to kill her- someone posts factual information for you (nic's post 571), but you never read it. You never respond.

It's been happening for quite a while now. You'll show up on this thread tommorow again saying Michael didn't spend Terrri's re-hab money on death attorneys,( never mind facts that nic or anyone else posted to you.)

If you want a debate, debate the facts, otherwise, stop propagandizing then disappearing.

Get back here and respond to what nicmarlo posted. By the way, I don't have a link, (maybe someone else does) but I recall reading that Michael within hours after Terri died, went to a judge to make sure he gets her estate, and no one is sure how much is actually there. And answer the question posed to you about Michael's testimony to
"TAKE CARE
(that's "take care ", not kill)
of Terri for the rest of
HIS LIFE"
( that's "his life". Not only is he alive, he's NOT taking care of her, and she's dead).

The last thing I would like you to do is go and watch the video's of Terri with her mom and dad, and listen to what they went through, having to watch her slowly die with police in her room, making sure they could give her no comfort whatsoever. Remember her mother begging for her life, her family and friends, priests reporting that Terri was hanging on and responding to them( recall Terri's smile at seeing her mom, dad, and family from the video's ).

Remember how this went on for 13 agonizing days, then you come back here and tell us how you can defend such a hideous abomination as what was done to an innocent, dependent, helpless woman, and her family.

What's wrong with you? Open your eyes.

Actually, I wasn't going to be petty enough to pick on the fact that you were mischaracterizing Terri's condition, and suggesting that her only options were to be tortured to death or abused for the rest of her natural life. I don't believe anyone would want to be treated the way Michael treated Terri. But I'm going to give you the benefit of the doubt and pretend you meant that 99.9% of people would rather be murdered than given love, care and rehabilitation that may or may not produce results.

You will stop at nothing to prop up your holier than thou arguments. So the game is over. These threads have become like the movie GROUNDHOG DAY, and I'm choosing to change the channel. Have fun villianizing a man who lived through hell...more hell than you lived one freaking day in your life. Good bye.

Hildy's e-mail to me:
PSSST...Terri's dead. Why don't you use your boundless energy on the living and stop hating so much. It'll bring you to an early grave as well, my dear.

Is that another one of your threats? Keep it on the public board. You have stalked me and threatened me in the past, and then somehow managed to get one of the moderators to suspend me for asking you to stop. Well I'm asking again. Stop.

The more people who can be diagnosed as "vegetative," the more can be gotten rid of. The more gotten rid of, the less demands, expenses and "burdens upon society, insurance companies, and hospitals" there will be by the elderly/disabled.....draining funds which "should" be better spent on America's youth."

Please indulge me for a moment.

Two years ago my 91 year old grandfather fell & broke his hip. For 91 he was as healthy as they come, still as strong as an ox. Age was beginning to take it's toll, but it was not a factor in his life.

I am a nurse. Tube feedings are as natural to me as feeding a patient or giving a baby a bottle. Legally a g-tube may be considered extrodinary, but in reality it's nothing.

Back to my grandfather. He had the hip repair, but it was discovered he had rectal cancer. He had yet another surgery which was considered a success. But he became depressed. Suddenly he was dependent upon the nurses for everything. He stopped eating. The subject of tube feedings came up.

I was the only one in favor of putting the g-tube in. As hard as I tried to make my mother understand, the tube feeding is no different from giving a baby a bottle. I told her that not putting it is is akin to putting a tray in his room and not helping him eat because he was to weak from the surgery to feed himself. An alternative route for nutrition.

But the doctors, nurses and hospice said "If it was my father, I would not put it in." Blah, blah, blah.

"Mom, there is a difference between prolonging the life of someone in the terminal stage of a disease and helping someone along who is depressed."

"But he has a DNR"

"Fine, if he stops breathing or his heart stops, do not subject him to recussitaion efforts. But do not starve (dehydrate) him to death."

"But he is going downhill everyday."

"Ya think? Two surgeries and no food? I would go downhill. Mom, the tube feedings will not prolong his life if he is terminal. In fact, the opposite is true. It will make him more comfortable as he passes."

I dug my heels in and was harsher than I needed to be because I knew, I still know I was right. He was not terminal. He was in a normal post-op depression, but because he was 91 the bias was to "allow" him to "die with dignity."

This is why I detest hospice. When making their decision my mother and aunt talked to hospice. They heard "gathering of angels" "death with dignity" and all of that romantic crap. Not one person told them what I knew to be true. If he is not terminal, you are killing him.

We have not spoken of it since he died except for one argument. The consensus in the family is that I was a pretentious know-it-all. There is a bit of a strain.

I have asked myself since was I insistent because I was selfish or was I right. I can honestly say I was right. I fought to give my grandfather a fighting chance.

But here I am a 51 year old woman who has dealt with death many times. I have had problems dealing with this grief because no matter how hard I tried, my mother and aunt chose death. I know they made their decision based on what they thought was right. It was not an easy decision for them. But when my grandfather stopped eating, he did not have a chance.

I've heard that some people become addicted to the death of others. It becomes an obsession for them. Not all of them progress to participating in the killings, but all the ones who do eventually kill start out slowly. Some of them start by killing small animals. Some of them start by stalking and making threats. Some of them start by living vicariously through notorious murderers. Some of them start by "compassionately" euthanizing one of their patients, or a relative. Once they experience that power, they want more.

I think what we are dealing with here are a handful of death addicts. They feed off each other's delusions, reassuring each other that the majority of people share their addiction. Much like an alcoholic, they don't see it for the addiction that it is. They view themselves as normal, and those who don't delight in their addiction (drugs, alcohol, death, etc.) as an abnormal minority.

"Death addicts"

I've heard testimony from serial killers, and "mercy killers" (like the repiratory tech who killed a bunch of his patients) where they say as much. They started killing and they couldn't stop.

The "kill Terri" crowd, certainly is delusional. Remember creepy Felos saying Terri looked beautiful after 9 days of dehydration? eeeeeeee, creepy.

Yes, that was creepy. And the addiction didn't stop at Terri. Remember Mae Maguirk? The kill-Terri crowd showed up on the Mae threads, demanding that we back off and allow Mae's granddaughter to murder her. When they failed, and Mae recovered enough to state her desire not to murdered, the death addicts were devastated. They were shrieking hysterically about the "right to die" and the interfering pro-lifers. It was a painful blow for them. They got partial satisfaction when Mae later died of natural causes, but they never really got over being denied another televised murder.

"Remember Mae Maguirk?"

Yes, that was something wasn't it? She even had her wishes in writing, and they ignored what was written there. Another point is, contrary to what the death freaks say, Mae didn't live for 100 more years on life support, she passed away of natural causes. (I think the 9 day starvation ordeal inflicted on her, contributed to her demise, but at least she was kept hydrated and fed. ) No one can stay alive past their time, no matter what life support they are given.

Protect the Bill of Rights: I read your post about your grandpa and agree you did the right thing in trying to keep him fed and hydrated. It's a shame people don't understand just how simple a feeding tube is. It's not life support. It's humane. You don't starve and dehydrate sick people.

Thought you might like to read about Mae Maguirk, if you haven't already. It's a story similar to your granddads.

GRANDMA MAE
