Watchdog Puts Herndon Planning Commission on Legal Notice Over Citizens' Objections to Proposed "Day Laborer" Site
Letter Details Proposal's Planned Violations of Law & Illegal Use of Taxpayer's Funds for Illegal Aliens
(Washington, DC / Herndon, VA) Judicial Watch, the public interest group that investigates and prosecutes government corruption, said today that it has provided legal notice to the Town of Herndon Planning Commission detailing Herndon citizens' objections to a proposed "Day Laborer" site. The Town of Herndon is currently considering committing public resources to facilitate criminal activity by illegal aliens. Judicial Watch represents concerned residents and taxpayers of the Town of Herndon and Fairfax County in this matter. Copies of the letter were sent to the Herndon Town Council, as well as Fairfax and Loudon County officials.
The Town of Herndon Planning Commission is considering an application by an organization representing itself as "Project Hope and Harmony" for a conditional use permit for a "Day Laborer" site to be situated on Town of Herndon property. A public hearing at the Town of Herndon Council Chambers is scheduled for Monday, August 1, 2005 at 7:30PM.
Judicial Watch's clients' concerns are numerous, but center on the use of taxpayer resources, including town property and county funds, to facilitate illegal activity. An official Fairfax County study concluded that 85% of "day laborers" lacked legal documentation permitting lawful employment. The proposal before the Town of Herndon entails committing public funds and resources to facilitate the illegal employment of undocumented aliens - a crime. Federal immigration laws make it illegal to "encourage or induce an alien come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law." 8 U.S.C. § 1324(a)(1)(A)(iv). Federal immigration laws also make it unlawful to aid or abet the commission of such acts. 8 U.S.C. § 1324(a)(1)(A)(v)(II).
Should the proposal go forward, Judicial Watch and its clients are prepared to challenge the "Day Laborer Site" in court as an illegal use of taxpayer funds and will seek declaratory and injunctive relief, attorney's fees, costs, and any other relief to which they are entitled.
"Public officials cannot commit taxpayer's funds and public resources in furtherance of a crime - no matter how well-intentioned," stated Judicial Watch President Tom Fitton. "Any attempt by Herndon or Fairfax officials to aid and abet criminal conduct with taxpayer money will be met with swift, strong legal action on the part of Judicial Watch and our clients," Fitton added.

Town of Herndon is determined that this will go through. When I called this morning, the woman I spoke with virtually sneered when I referred to this as a "proposed" site. Her response was, "What do you mean, "proposed?" She pretty much let me know that this is a done deal, and they're just working out the details.
She told me that it's town/county taxes funding this, but she couldn't tell me whether Project Hope and Harmony's contribution included state or federal grant money. Project Hope and Harmony's contribution includes public funds according to news reports.
Of all the calls I made today, the ONLY agency that I got an ounce of interest from was the Commonwealth's Attorney General's Office. The rest seemed not to want to hear/deal with it, including Wolf, Warner, Allen.
Granted, I'm new to making calls and hoping for answers. Everyone I spoke to said to send a letter. I feel brushed off, but I will write my letters. Hopefully the end result won't be feeling more brushed off, but I'm not hopeful.
I guess the left-wing activists and cheap-labor lobby are pretty powerful.
This makes me smile. I am glad JW is taking on the representation.
I only hope they are successful. They should be -- I designed the legal strategy for their client. I only wish a conflict had not precluded me from implementing it.
Just keep on calling and writing. Keep a log of everyone you speak to and what they say. Document all of this. If nothing comes of it or if they keep shining you on, start writing letters to the editor, etc. letting them know who's refusing to answer your questions and/or to provide you with information.
You'll need to get used to people not wanting to deal with this. :)
Further, it will do little more than consolidate the Hispanic day laborer pick up points so that Mara Salvatrucca (MS 13) gang members can better identify them for purposes of extortion.
I think someone ought to check into the background of the folks who proposed this as well as the background of the town planning people who let it go through to this stage of development.
This is a big problem. It is endemic throughout Northern VA. Now is an opportunity to make a stand. We all need to come together on this. The hell with our elected officials - they won't do anything about this until it means they have to worry about being re-elected. I don't bust my ass everyday to pay for illegal aliens. I bust my ass to provide for my family and for the benefit of my children.
Thanks.
Good post - thanks!
I am all for:
Judicial Watch lawsuit
Possible RICO violations charged against city for abetting illegal aliens
Criminal actions against citizens who sign up as wanting illegal alien laborers, at the site (the records of who has hired can be subpoened and made public)
Recall Election petitions against all Town Council members who issue an "aye" vote in the next few weeks
This can and will become a national issue. The whole world is watching. The whole illegal alien community in America is watching through their Hispanic media and American liberal supporters. However, the backlash IS coming, make no mistake about it.
are there further, additional ILLEGAL ALIEN FR PING LISTS that can be "pinged" on this?!
A little bit of good news....
I heard on the radio this morning that those who attended were roughly 80% against and 20% in favor of it, and the meeting dragged out until 2:00-2:30 a.m.
The Planning Commission voted it down, so now it is in the hands of the Town Council who will vote on August 16.
Here's an update:

Planning Commission Votes Against Day Labor Site
HERNDON, Va. (AP) - A set back for those hoping to build a site in Herndon for day laborers.
WMAL reports the planning commission voted early this morning against the site. A third public hearing on the matter was held last night. On Monday, hundreds of people signed up to speak at the hearing -- so many the extra session had to be added.

announcing that "NOE" vote in Herndon, just now.
I think the public officials are AFRAID of the people. The People have risen up in a backlash. This will be all over the Latino news, too.
