Missing Girl Found In Mexico With Convicted Molester

Man Admits Committing Sexual Acts On Child

SAN DIEGO -- A convicted child abuser [Actually, he was convicted of committing a lewd and lascivious act upon a child under 14.] arrested in Mexico on suspicion of sexually abusing an 8-year-old girl kidnapped from her Nevada home will apparently serve time in a Mexican prison, authorities said Saturday.

Lydia Bethany-Rose Rupp was found at about 6 o'clock Friday night at a homeless shelter after a telephone tip led authorities to an address in Ensenada, FBI spokesperson April Langwell said.

The suspect, Fernando Aguero -- also known as "Flaco" -- was arrested and will probably serve time in Mexico, according to Northern Baja Attorney General Antonio Martinez.

Aguero admitted to committing sexual acts with the child while in Mexico and will be imprisoned there for many years before he can be prosecuted in the United States, Martinez said.

Martinez said the maximum prison sentence Mexican prosecutors can ask for is 38 years.

The tip that led to the child's rescue was from "a concerned citizen who had recognized (the suspect) from one of the flyers put up in Mexico," Langwell said.

The child was taken from her Fernley, Nev., home the afternoon of July 22, but her mother did not call authorities until 11:30 p.m., authorities said. An Amber Alert was issued the following day.

Lyon County (Nev.) sheriff's Capt. Jeff Page escorted the girl's mother to Mexico for a reunion with her daughter. The child was examined in Mexico to ensure she had no injuries, Langwell said.

Following an interview with the FBI, Lydia and her mother, Carmen Bauer, were going to head home, Langwell said.

Aguero had befriended the child's mother through her church last spring and soon after moved into the woman's apartment, Page said.

On the day of the kidnapping, Aguero called the child's mother at work to tell her he could not pick her up and she needed to get a ride home, Page said.

Page said the woman was not concerned at first when she arrived home and her daughter and boyfriend were gone. A few hours later, however, she realized the child's birth certificate, social security card, pictures and other belongings were missing, Page said.

After calling around without success, the woman called authorities, Page said.

Authorities initially believed Aguero had headed toward Southern California, with the possible intention of going to Mexico.

Aguero was released from prison 10 years ago for committing a lewd and lascivious act upon a child under 14 in Los Angeles, Page said.

A Nevada judge had issued a $1 million arrest warrant for Aguero on a kidnapping charge, Page said.

The following is from the Reno Gazette-Journal.

Fernando P. Aguerro, 48, is a native of Tjuana, Mexico. He uses various aliases including Aguero, Gonzales, Pons, Ayala and Vega. Aguerro speaks little English (according to the manager of the trailer park where Aguerro resided in Nevada).

In the 1980s, Aguerro was convicted in Los Angeles of lewdness and lascivious behavior with a child under 14 and served one year in prison. He failed to register as a sex offender in Nevada.

I can't figure out why he's going to be imprisoned in Mexico instead of being tried here where the kidnapping occurred.

Let him do the 38 years in a Mexican jail first. Their prisons aren't quite as nice as ours.

Actually their prisons are much nicer then ours........if you have lots of money!

The Mexican authorities as a general rule won't extradict Mexican citizens. But that does not mean they can't be tried. They can bring them to justice using the Mexican justice system. If he really spends 38 years in a Mexican prison, that's alright by me. But the question is whether he'll really be punished.

For the mother to be stupid enough to pal around with
and have living in her home when looking at this guy
you can see he isn't kosher
The girl should be taken from that mom.

48+38...Mexico can have him. If he lives that long and is finally extradited, he should be in jail for the rest of his miserable life.

LOL, no, not that church.

The couple had met in church... and soon became involved, eventually living together in Villa Park. [Pastor Matt] McCreary said the church frowned upon the living situation and urged them to make other arrangements.

McCreary, who ministered to Lydia's family for more than a decade, said he and other church members confronted the mother last week because they feared that Aguerro and Lydia were becoming "too close." McCreary, who heads Living Faith Christian Fellowship in Fernley [that's in Nevada, I think], said Aguerro was aware the girl's mother wanted him to leave.
