From Abrams Report:

Lincoln Gomez states its never to late for the defense to pursue having the dna samples thrown out due to what the defense attorneys claims as taken under improper procedures. If the judge decides in their favor, the dna samples will be thrown out and other samples taken.

Defense attorneys not allowed to speak with the witnesses at the present. Should the case go to trial then the defense can question the witnesses.
