WSJ: ACLU Jamboree - Judge Manning and her ACLU declare war on the Boy Scouts.
Wall Street Journal ^ | July 20, 2005 | Editorial (full text)

The American Civil Liberties Union has found a sympathetic ear for its latest assault against the Boy Scouts. At issue is the famous Jamboree, held since 1981 at Fort A. P. Hill in Virginia and indirectly receiving support from the Army in billeting, infrastructure, and so forth. The ACLU argues that this arrangement breaches the First Amendment's separation between church and state. A federal judge in Chicago concurs, declaring government aid for the Jamboree unconstitutional.

Because the Scouts require members to "privately exercise their religious faith as directed by their families and religious advisors," the ACLU petitioned the court to declare the organization "theistic" and "pervasively sectarian." Judge Blanche Manning didn't go quite that far last month, but she did rule it an overtly religious association because it "excludes atheists and agnostics from membership." She ordered the Army to expel the next Jamboree from Fort A. P. Hill in 2010, by which time we trust the Seventh Circuit Court of Appeals will have overturned her decision.

Judge Manning didn't cancel this year's Jamboree, which will go on as scheduled next week despite the perils to the Constitution. If Her Honor paid a visit, she'd learn that the 40,000 young men aren't gathering for a tent revival meeting or Great Awakening. Mostly, they're getting together to cultivate an appreciation for the outdoors and to participate in the rites of summer camp.

More to the point, the Scouts will celebrate what they call their "bedrock values," which, yes, include faith, but also patriotism, courage, service, conservation and civic virtue. Contrary to Judge Manning's inability to "ascertain any harm to the public interest in enjoining the Jamboree," we would argue that the values the Scouts embody are vital to the national good and in need today, more than ever.

Now I'm doubly perturbed.

First, I had to drop out as Scoutmaster of one of the Jamboree Troops due to a business conflict -- would have been my second stint as a Jambo SM and an absolute delight.

Now this. 2010 marks a very special Jamboree -- instead of the usual four-year span between National Scout Jamborees, there will be five years before the next one so that it can celebrate the centennial of Boy Scouting in the U.S.

Moral Absolutes/Homosexual Agenda Two-fer.

This is for both lists because usually the ACLU attacks the Boy Scouts for not allowing pederasts access to the young boy scouts; this time the attack is because the Boy Scouts do not teach atheism.

Think of the BSA when you make charitable donations.

Freepmail me if you want on/off this pinglist.

I've removed United Way from my charitable donations and rerouted all my limited funds to the Scouts in payback for their pusillanimity.

With regards to the military funding the Boy Scouts?!?! I'm sorry, but I'm just not seeing it...\

And for the books, separation between church and state means no national church, such as the Anglican church, aka the Church of England...

Chicago

A federal judge in Chicago says the Pentagon can't fund the National Boy Scout Jamboree after this year.

U-S District Court Judge Blanche Manning recently signed an injunction that bars the Defense Department from financially supporting future jamborees, which draw thousands of Boy Scouts from across the nation every four years.

More:

The June 22 order by U.S. District Judge Blanche Manning stems from a 1999 lawsuit by the American Civil Liberties Union of Illinois that claimed the Defense Department's sponsorship of the Scouts violates the First Amendment because the group requires its members to swear an oath of duty to God.

The Department of Justice, which represents the Defense Department in legal matters, said Thursday the government was still considering its options and had not yet decided whether to appeal, said Justice Department spokesman Charles Miller.

The order doesn't cover this year's National Scout Jamboree, which gets under way July 25 and is expected to draw more than 40,000 people to the Army's Fort A.P. Hill in Virginia. The next jamboree, typically held every four years, won't be held until 2010 to coincide with the Scout's 100th anniversary.

More:

Mr. Bork said the ACLU's actions show the watchdog group's lack of a "moral compass."

"This highlights more than anything else how rabid the ACLU is about the Scouts. They can't seem to let go of the Boy Scouts for anything. It's really unfortunate. They want to attack the Boy Scouts of America and the Pentagon for supporting the Boy Scouts, and they want to support kids running around naked in the woods."

Mr. Bork was referring to an ACLU lawsuit filed earlier this year in support of a proposed children's nudist camp in Virginia. A federal judge ruled in July that teens and children could not attend the camp without a parent or guardian.

"Their moral compass is turned around 180 degrees. I don't get it," Mr. Bork said.
