The short answer is: J. Harvie Wilkinson III. A longer answer to the question of who President Bush should nominate to fill today's Supreme Court vacancy is: Constitutional law is rife with clashing certitudes generated by too-clever theories purporting to illuminate the one valid approach to construing the Constitution.

I believe Wilkinson is 60 years old. I hope he would go for a youger person, one in the 48-55 range.

J. Harvie Wilkinson III--if there is a more Supreme Court justice-sounding name, I haven't heard it. He should definitely be getting more consideration than he seems to be at the moment. An interesting side-note, he ran for Congress as a Republican during law school (1970) and lost.

Wilkinson is a little too moderate and old for my taste. But, he would be far preferable to our attorney general.

Shut up, George. Stick to baseball.

A guy who graduated Yale and is the III is de facto establishment. The Dean of Richmond law school, who knows both Luttig and Wilkinson, said that Luttig "is decidedly stronger in his legal conservatism."

Also, the Dean "told The Times-Dispatch that Wilkinson reflected the approach of his mentor, Powell. He called Wilkinson a classic centrist who can accept compromise at the expense of logical precision. That contrasts with Luttig, who Smolla said tends to be a purist in his intellectual views."

Will go for the purist. But, thanks for the Washington establishment advice, George.

Sounds a LOT like O'Connor. No Thanks, Mr. Will.

The man Bush should appoint to replace O'Connor happens to be a woman - Judge Edith Jones.
