SEN. SCHUMER CAUGHT ON CELLPHONE: 'WE ARE GOING TO WAR' OVER SUPREME COURT
The Drudge Report ^ | 07/06/05 | Drudge Report

**Exclusive**

Senate Judiciary Committee member Chuck Schumer got busy plotting away on the cellphone aboard a Washington, DC-New York Amtrak -- plotting Democrat strategy for the upcoming Supreme Court battle.

Schumer promised a fight over whoever the President’s nominee was: “It's not about an individual judge… It's about how it affects the overall makeup of the court.”

The chairman of the Democratic Senatorial Campaign Committee was overheard on a long cellphone conversation with an unknown political ally, and the DRUDGE REPORT was there!

Schumer proudly declared: “We are contemplating how we are going to go to war over this.”

Schumer went on to say how hard it was to predict how a Supreme Court justice would turn out: “Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again.”

Schumer later went on to mock the “Gang of 14” judicial filibuster deal and said it wasn’t relevant in the Supreme Court debate.

“A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court.”

By the time the train hit New Jersey, Schumer shifted gears and called his friend and “Gang of 14” member, Republican Sen. Lindsey Graham.

The two talked in a very friendly manner about doing an event sometime this week together.

Correct. My husband overheard a conversation last week by an FBI agent, he presumes, who was talking about how they were covering the Live 8 concert in Philadelphia. They had identified suspects and were "keeping a very watchful" eye on them. They may have been following suspects. All hubby was doing was eating his lunch...

Why do you say "Mr Bush" instead of President Bush? He really IS our president, even though the lame media would like us not to put the two words "President" and "Bush" together, as they do as seldom as possible.

The radical left that funds them is insisting that the Democrats oppose any/all Bush nominees because they don't think he was actually elected. Twice.

So why be surprised? We knew this was coming, they have telegraphed it for going on 5 years now.

Listening in to one side of a conversation is NOT wiretapping if that call is made in a public setting. Add to that - most modern cell phones are not subject to interception.

I believe the term "litmus test" emerged in the Reagan administration, when Democrats accused him of imposing such a test vis-´-vis abortion. But Democrat Senators always insisted they had no such test.

Schumer was the first to be honest and say that ideology and philosophy was a litmus test for him. It would not only influence his vote, but his attempt to use strong measures such as holding the nominee in committee and the filibuster.

was overheard on a long cellphone conversation

The call was overheard, not electronically intercepted. It was a one-way conversation that was heard.

Intercepting a call electronically is a crime. Overhearing a conversation is not.

I have been saying since O'Conner handed in her resignation that the 'Rats would fight virtually any nominee--up to and including Schumer (Heaven forbid) himself.

From their POV, they need a scalp. Nothing else. That will placate their base and donors. Somebody will have to be nominated eventually.

The Democrats are preparing for war. They have no problem insisting that a Supreme Court Justice MUST hold the opinion that the Constitution somehow protects a woman's "right" to pay an abortionist butcher to dismember the unborn child in her womb and suck it into a sink. Yet, Bush says he will not use abortion as a consideration and he is telling his troops (his base) to "cool it" (or in other words to sit down and shut up.)

We need to prepare for war. We need to fight hard, take no prisoners, and leave only scorched earth behind us. We have the White House and both houses of Congress and there is no excuse that we don't put a pro-life originalist Justice on the SCOTUS. We've fought for decades to get to this position and no one, not the obstructionist Democrats, not the spineless milquetoast Republican Senators, not President Bush promoting his buddy while pandering to some ethnic group, NOBODY should stand in the way right now.

It is not the time to back down, compromise, get along, appease the Democrats and leftist media, "tone it down" or give even a single inch. It is time for war with anyone and everyone that stands in our way.

This is far too critical to lose right now. The Democrats and other leftist vermin who infest this country are going on a war footing right now. We must also prepare for war. I'm reminded of the film adaptation of Tolkien's Lord of the Rings when Theoden, King of Rohan, said, "I will not risk open war." and Aragorn, future King of Gondor replied, "Open war is upon you whether you would risk it or not." Open war is upon us today, in fact it has been on us for decades and the toll has been over 40 million slaughtered by abortion since the Supreme Court's tragic Roe v. Wade decision in 1973. Now the battle is joined again and we have a window of opportunity - a chance at victory after this dark and devastating three-decade battle. No single person, public figure, or political party is more important than the outcome of this fight. For those who stand in our way at this point in time upon which the future of this battle turns we should leave only stubble and ash. Now is the time.

The name "Schumer" and the phrase "go to war" conjur up all sorts of ridiculous images in my mind.

Stand up, hook up, and shuffle to the door, Chuckie...

I guess Chuckie is getting bombarded with calls asking for his reaction. I was on hold several minutes and finally hung up.

Is that true if you overhear the talk instead of electronically intercepting it?
