I read on Fox News that the judge said he didn't know about Duncan's past.

It's his business to "know" before he grants bail. Either the judge didn't care enough to ask or someone covered up "Duncan's past." The judge has an obligation to resign or explain why he didn't know. I wish we could get full details on every judge who lets vicious criminals out without proper restrictions.

It is the district attorney who should know that stuff and bring it up at the bail hearing. The district attorney only asked for a $25,000 bail, which is STILL too low. It sounds like the district attorney was asleep at the wheel, with tragic consequentces. The DA needs to explain why they didn't know this guy was a level 3 offender.

What about the prosecutor that only asked for $25,000 bail? That seems low if they knew this guy was a sex offender. I would think it would be the responsibility of the prosecutor in this case to use the information this guy was a sex offender to get the bail a lot higher then $25,000. Put up $2500 and get out of jail free -- skipping bail means nothing to someone like this.

Personally the justice system seems to have failed all along the way and now most of a family has been murdered because of the incompetence of people that are placed to positions to protect the public.

Actually, the prosecuter should have TOLD the judge the circumstances.
