I disagree, it is the JUDGE's reponsibilty when it comes to these heinous lowlifes walking free. Write him at this address to express your outrage at his decision that KILLED that little child. These high and mighty judges MUST be held accountable:

Duncan had spent more a decade in prison for sexually assaulting a 14-year-old boy at gunpoint, and at the time of his arrest was a fugitive from justice for allegedly molesting a boy in Minnesota.

There were three crimes under the common law that were capital offenses.

Murder, rape, and kidnapping.

Since, in most cases, we no longer follow that mode, I guess it means that we, as a society, don't mind if there is some murdering, raping, and kidnapping going on.

Idaho has the death penalty and uses it, however, Duncan took the girl across the country, so this will be a federal kidnapping case.

I found him with a Google search, but they don't seem to list party affiliation for judges. Probably they have some sort of county political machine run by whichever party has the majority.

He won the 2004 election in Becker County unopposed, except for a few write-in votes. Here's the figures. You can find him on the table by searching for his name:

Thanks for clarifying...I thought I had read somewhere that the man who was killed was the mom's husband, and I thought I guess that he was also her father.

Thank goodness she has her father.

I'm praying he wasn't sexually aroused with Shasta because he was into little boys.

But I want to know only ONE answer. Did Duncan do all this by himself from day one?

Shasta will be able to tell us if Duncan took her from the farm house.

From what I heard - seems it was a month before the triple murder - this pervert, with a long rap sheet that included raping boys and declared a dangerous sex offender, was released on $15,000 bail.

Human Remains Found in Missing Boy Search

Authorities on Monday said they found human remains during their search for a missing 9-year-old boy whose sister was found days earlier at a Denny's restaurant with a registered sex offender.

Sheriff Rocky Watson said the remains were found in western Montana would be sent to an FBI laboratory for DNA analysis. He did not say whether the remains were believed to be those of Dylan Groene, and declined to answer questions.

Officials said previously that there was little hope that Dylan was still alive.

Dylan's 8-year-old sister, Shasta, was found Saturday with Joseph Edward Duncan III, more than six weeks after the children disappeared from the home where their mother, her boyfriend and an older brother were bludgeoned to death.

Authorities planned to charge Duncan, 42, of Fargo, N.D., with kidnapping and being a fugitive from justice, and have said more charges were possible. A judge ruled Monday that there was probable cause to keep Duncan in jail until an initial court appearance Tuesday, when he will be assigned an attorney.

With Duncan refusing to talk, authorities have been relying on statements from Shasta, physical evidence in Duncan's Jeep and tips from the public as they searched for Dylan.

Sheriff's Capt. Ben Wolfinger said Shasta had provided helpful information, but declined to say what the girl was telling officers.

"It's a slow process with Shasta," Wolfinger said Monday. "We're taking that very slowly."

The girl's father, Steve Groene, said Sunday that he was told not to ask the girl questions about her ordeal, but had held out hope that Dylan would be found safe.

He said Shasta was doing well and had been watching animated movies and had a vanilla shake and pancakes for breakfast the day after she was found.

"I would especially like to thank all those involved in the search for Dylan and Shasta," he said in a brief statement. "A special thank you goes to the people at Denny's, who were alert enough to recognize Shasta and make that 911 call. The Groene family truly feels you all are heroes."

The children were declared missing when authorities arrived at their home May 16 and found the bound and bludgeoned bodies of their mother, Brenda Groene, 40, brother Slade Groene, 13, and their mother's boyfriend, Mark McKenzie, 37.

Investigators said they had received some 100 tips about Duncan and the red Jeep Cherokee he was driving since photos of the two were released Saturday.

Based on those tips and other information, authorities believe Duncan and the children remained in the Northwest during the past seven weeks, but Wolfinger declined to say where. He also would not say if there was any evidence others were accompanying Duncan.

Duncan, who was raised in Tacoma, Wash., had spent more than a decade in prison for sexually assaulting a 14-year-old boy at gunpoint, and at the time of his arrest was a fugitive for allegedly molesting a boy in Minnesota.

A registered high-risk sex offender, Duncan was released on $15,000 bail earlier this year after being charged with molesting a 6-year-old boy at a Minnesota school playground.

Police in Fargo said they had been looking for Duncan since May, but had no indication he had fled to Idaho.

Steve Groene said he had never heard of Duncan before Saturday.

The DA didn't tell him? Yes, the old "nobody told me" excuse. Surely he is allowed to ask. I wonder how far that would go as a defense before this same judge. It seems that "ignorance" is an excuse if you are connected to law enforcement, a judge or a prosecutor but not for us "civilians."

Odd phrasing ... I wonder if this is just sloppy writing, or if Mr. Groene is not Dylan's father?
