Newsweek: Gonzales Pick Will Doom Jeb Bush

f President Bush chooses Attorney General Alberto Gonzales to replace retiring Supreme Court Justice Sandra Day O'Connor, that might well doom the GOP Senate incumbents, those on the religious right say, by infuriating the party's fervent, evangelical grassroots, Newsweek reports in the current issue.

"If the president is foolish enough to nominate Al Gonzales, what he will find is a divided base that will take it out on candidates in 2006," says Manuel Miranda, who heads a coalition of conservative groups called Third Branch Conference.

A former legal counsel to Senate Majority Leader Bill Frist, Miranda went on to threaten retribution against Bush's brother Jeb, should he decide to run for president.

"We're not Republican patsies," he tells Newsweek. "Jeb Bush can go sell insurance."

Newsweek Chief Political Correspondent Howard Fineman and Deputy Washington Bureau Chief Debra Rosenberg preview the battle ahead for O'Connor's replacement in the July 11 cover, "O'Connor's Odyssey" (on newsstands Monday, July 4).

"This is probably the most significant Supreme Court resignation and nomination we'll see in our lifetimes," says Jay Sekulow, counsel of the conservative American Center for Law and Justice. His counterpart at the liberal Alliance for Justice agreed. "The stakes are now enormous," says Nan Aron.

Also in the cover package, Assistant Managing Editor Evan Thomas and Contributing Editor Stuart Taylor Jr. recount the legacy of O'Connor and her years on the bench, where she was the classic swing vote in countless 5 to 4 decisions.

Newsweek also lists the likely contenders for O'Connor's successor: Edith Brown Clement, a Fifth Circuit judge; John Roberts, a judge on the U.S. Court of Appeals for D.C.; J. Michael Luttig, a Fourth Circuit judge; J. Harvie Wilkinson III, a Fourth Circuit judge; Janice Rogers Brown, a judge on the U.S. Court of Appeals for D.C. and Gonzales.

You don't know what his views on abortion are. A Texas Supreme Court justice does not have the opportunity to write cases on that issue. He takes the law as given--from the US Supreme Court.

The reality is that you really don't know very much about Gonzales' record at all because he was only on the Texas Supreme Court for 2 years. That's not long enough to write enough cases to establish any real record.

If your criticism was that Gonzales was only on the court for 2 years, and thus does not have an established conservative record, then I might understand the logic at least, but it ignores that 4 out of seven Supreme Court justices appointed by Republican Presidents based on their supposedly conservative records turned out to be liberals. Obviously, looking at their records doesn't work. What you really need is a nominee who the President knows personally, and who he knows will support his conservative agenda.

One thing I know for sure is that there is no way he can politically get away with nominating a White male even though the vast majority of qualified candidates are. And some say there is no more racism in America....

What are his views? Do you have a record of his published personal views? Got links so we all can read? Don't confuse his rulings regarding cases and applying the law as written by the Texas Legislature as his personal views.

My first impression is that you are completely correct but then it occurred to me that the Senate Republicans may well be forced to act because of the magnitude of the position. IOW, the fact that it is a SCOTUS nominee may mean that the combined pressure from the party proper, Republican voters, and the President may force those chickens into a corner where it's fight or die.

I think President Bush should nominate Judge Joe Brown.

I'm not joking. The guy would be great. And he wouldn't hesitate to tell those high priced lawyers to shut up and stop acting stupid.

That ALONE would be worth the price of admission.

Gonzales is a dangerous liberal leaning judge. He consistently upheld abortion rights in Texas. You have to remember, these guys get all hung up on themselves once they get up there (i.e. Kennedy keeps a scrap book of himself). Any liberal or moderate inclinations and then when in the spotlight they kiss their "constitutional" convictions and your constitutional rights bye bye.

Keep bashing Jeb Bush. You all know nothing about him other than he didn't go give Terri a drink under cover of darkness and accompanied by some SWAT team.

Some of you need to get a life. Jeb has been a great governor. Trust me. I live here.

No one could have handled the 4 (yes FOUR) major hurricanes that hit our state better than he did. NO ONE.

We STILL live in a state income tax free state thanks to Jeb Bush.

Quit your freaking whining. If you live in FL and want to bash him, fine. But if you live in Pittsburgh or Des Moines, or Chicago, it's none of your damn business what Jeb Bush does or doesn't do.

You need to chill out my friend. Apparently this is a sensitive subject for you. I am a Texan. I don't know where you are from but I happen to know a little bit about Al Gonzales. He is not a dyed-in-the-wool pro-life choice and he favors Affirmative Action. I didn't say I couldn't live with him but I tell you now, the Ultra-Conservatives do not care that much for him.

Now, go take a deep breath, count to 10 and relax.
