The Dems allowed her confirmation a few weeks ago, so they'll have a difficult time invoking "special circumstances" this time around.

You're forgetting the language of the "memorandum of understanding" ... filibuster only in "extreme circumstances." I promise you Ted The Swimmer Kennedy will view a SCOTUS nomination as an extreme circumstance.
