NEW YORK - Time Inc. said Thursday it would comply with a court order to deliver the notes of a reporter threatened with jail in the investigation of the leak of an undercover CIA officer's name.
U.S. District Judge Thomas Hogan is threatening to jail Matthew Cooper of Time and Judith Miller of The New York Times for contempt for refusing to disclose their sources.
The Supreme Court on Monday refused to hear the reporters' appeal and the grand jury investigating the leak expires in October. The reporters, if in jail, would be freed at that time.
In a statement, Time said it believes "the Supreme Court has limited press freedom in ways that will have a chilling effect on our work and that may damage the free flow of information that is so necessary in a democratic society." '
But it also said that despite its concerns, it will turn over the records to the special counsel investigating the leak.
The grand jury ends in October. I don't think there can be an October surprise in a non-election year.
I think Fitzgerald knows already, Joseph Wilson's allegations against the Bush administration were politically motivated, grandiose, self-serving lies. Fitzgerald will announce, that no one should be prosecuted. Wilson will be disgraced by Fitzergerald's findings. I can't wait for Novak to be able to lay it all out. I can't wait for Chris Matthews to look the total fool for his vicious, accusatory rants against VP Cheney and Scooter Livvy. It's gonna happen soon.
(I've always thought Matt Cooper would squeal like a "Deliverance" pig before he would ever go to jail. Unlike Judith Miller, who seems tough and principled to me.)
Federal grand juries are empaneled for a specified period of time to hear fedreal cases, IIRC. This jury would be hearing any number of cases during their term. They are not in session every day.

right, Novak has given the name and perhaps some evidence to substantiate it. that's why Copper and Miller just can't go in there and lie about it, its a perjury trap for them.
Most interesting. It wouldn't surprise me at all if the surprising thing is that Wilson outted his own wife. As indeed I believe he did.
Thanks for posting that. It is one reason (of several) that I and others have long opined this investigation was not as conventional wisdom would have it.
And Novak said he WILL be writing about it once Fitzgerald wraps up, so even though we may not see Cooper's own notes (as I earlier stated my doubts), we will get a more fleshed out story.

Joseph Wilson will be thoroughly discredited when Fitzgerald releases his report. Of course he won't acknowledge it. Won't slither away in disgrace like Republicans do. No... like all lyingass Democrats, he will get lots of msm sympathetic air and ink, and continue his assault on the Bush Administration. And still get invited to all the best parties.
Could Novak have cut a deal?
