The fact that guido went to get a couple of friends before jumping these guys makes it pre-meditated.

Yeah, well, if you walked through Bed-Stuy at 5am, you'd be seriously injured too. So to the South Bronx, so to parts of Harlem. Especially if you were there to steal their car .. and it isn't hard to tell, I can spot the car theives in my neighborhood because they go around yanking door handles and have other charastic mannerisms. Everyone who lives in the inner city can spot a group of people up to no good. You must do so to survive.

Black folks aren't the only people that have to avoid certain areas. White folks just happen to rarely go into black neighborhoods to steal stuff, otherwise, the opposite would be a daily headline.

If you see a bunch of guys walking around in the middle of the night, looking into cars, and trying their doors, it doesn't take a rocket scientist to figure out they were trying to steal a car or a stereo system.

Frankly, this sounds to me like a guy who's had his car stolen one time too many and has taken it upon himself to patrol his neighborhood in order to catch people just like these guys.

As for the two extra guys, somehow I doubt they exist. What are the chances of him having time to go get two extra guys (in the middle of the night) and then come back and the wanna be thieves are still there.

I suspect he got out of his SUV and clobbered the one guy with his bat and the other two ran off. Sure, he should have called the police, but he has probably tried that too, and been frustrated.

He shouldn't have attacked the guy, but I have a hard time classifying this as a hate crime. Unless this guy says he would have only attacked black guys who were trying to steal a car instead of any guys who were trying to steal a car, then proving this is a hate crime is going to be difficult. My guess is he will be convicted of assault and battery.

The NY Daily News story has a few more details. They had already tried to steal a car but ran off when a light went on in a house. Maybe this was known and they matched the description.

The NY Daily News story also mentions that Moore had a hammer and other tools. Maybe those were exactly the type of tools car thieves carry and maybe they were visible.

Either of those facts would explain the confrontation. There's a whole lot we don't know yet.

Exactly. The 3 black guys were, at that point, just walking around. We know now that they were up to no good, but the attacker couldn't have known that for sure.
