For what it's worth, it looks like Souter and company are working their way through the Code of Hammurabi and reversing all of its standards ~ which is pretty egregious since this code was one of the earliest efforts of a society that invented civilization, writing, and the keeping of records.
It's hard to believe that we have a Supreme Court that says that we should now have as a law of the land something considered to be a capital crime at the very foundations of civilization.
