WEST PALM BEACH -- Rush Limbaugh's attorney asked a judge Wednesday for copies of the conservative commentator's sealed medical records so he can provide a list of privileged information that should not be turned over to prosecutors investigating Limbaugh's drug use.

Rush should be able to send Sandy Berger in to examine these records. But I am sure that will not be possible becuase they will undoubtedly be treated with more care than our national secrets.

Assistant State Attorney James Martz said investigators want to review all the records because the alleged criminal conduct spanned years and they could find evidence of a pattern or additional wrongdoing.

This sounds ominously like a fishing expedition to me. What kind of proportionality is at work here? We are going to examine medical records which federal law declares are quite personal and prescribes severe penalties for making them public. And we are going to examine records going back over years? And because they might find evidence of additional wrongdoing?

And this extroadinary action is to be justified by an alleged crime which this jurisdiction has never or only once before prosecuted? Against a suspect who did not profit or push? Who consumed only legal drugs. Who is now rehabilitated?

This story is written to do maximum PR damage to Rush. The motion, on his website, makes clear that Black wants a privilege log. This is to be expected. The government doesn't have a right to all his medical records. It has to identify those records it thinks are useful, with the oversight and concurrence of a judge.

I did not know that, in fact nobody KNOWS that. It has been alleged that Rush paid hush money but only alleged. I also do not recall Rush ever saying that all drug users should be put in jail either. Many libs, socialists and commies listen to Rush, which category do you fall into? I ask this because the crux of the issue is whether or not the government has the right to seize medical records without a specific charge or particular piece of evidence in mind. Only a communist, a socialist, or *"liberal" would have the poor judgment to accept the premise of the socialist DA from Florida. So once again I ask... which of those three are you???

No I do not know that Rush paid his maid $80K and I submit neither do you. Nor do I believe you are possessed of any evidence that she supplied him 30 thousand pills.

I want to let him off the hook because I want to let everyone off the hook for drug crimes. I have long believed the use should be decriminitalized. This fishing expedition in furtherence of no social or legal good is designded to advance no legitimate purpose except political gotcha. That is only one reason why drug laws must inevitably be repealed. Grant that it happens while we still know how to spell civil liberties.

Amazingly, when the Republican-controled legislature and the Republican governor decided to make "doctor shopping" a felony, they completely ignored the law of unintended consequences.

We should remember this every time a politician asks us to give up more of our rights to fight noble causes.

The accusations regarding the woman buying the pills are true and accepted for the most part even if the numbers are guesswork. There are so many ways to defend Rush I see no reason to deny he was guilty. We can defend him based on the medical privacy issue. We can defend him on the fact that no one who has sought treatment has been prosecuted for this before and we can defend against the charges of hypocrisy. I'm still disappointed in Rush for offering such an easy target and for the fact that he is a mere mortal.
