What would happen if the DOD told the ACLU to go pound sand?

The President of the US could, on behalf of the DoD, announce that as Commander in Chief in wartime he would order his subordinates to reject this court order because it would cause more Americans to be killed. Then the issue would be squarely put.

Based on prior cases, and by a narrow margin, I believe the US SC would rule for the President in that circumstance.
