Horse hockey. When I was growing up in the '50's cigarettes were called coffin nails and everybody knew people who smoked who died with lungs resembling full ashtrays.

In the 1600's most Englishmen considered smoking to be a dirty and unhealthful habit.

I don't know about England, but the first US SG's warning about the health dangers of tobacco, including cancer, came out in the late forties.
It is true that warnings were not placed on tobacco products until years later but everyone pretty much knew what the deal was long before the warnings were on the packs.

It may be of interest to you to know, that had this case succeeded, there were going to be many more lawsuits of this type to follow. This decision has effectively blockaded that route.

What's really interesting about the tobacco industry in the US is that, in the past 15 years, it has allowed itself to become a ward of the state, with regulated profits and a certain amount of earnings being siphoned off for various settlements. New entrants to the tobacco business love it. Tobacco is the US caved in to various state lawsuits because they were promised they wouldn't get the "death penalty," but rather would be "milked" like a state utility. No one lost their job. Business as usual.
