The prudent person instructing would have either changed the transmission selection of gear (neutral, reverse, park in that order of select) or turned the ignition off. That was his job!

Negligence would imply lack of care or concern. If the father had no care or concern for the safety of pedestrians, then why did he choose a parking lot for the location?

Not a true statement. It's not always one of the drivers being negligent. Remember the Firestone Tire fiasco with all the SUV roll-overs? Those drivers never knew what hit them.
