MALDEF files civil rights lawsuit in Albuquerque

ALBUQUERQUE (AP) - A Hispanic advocacy group has sued the US Border Patrol and Albuquerque's public school district and police.

The Mexican American Legal Defense and Education Fund alleges three Hispanic students' constitutional rights to an education were violated.

The lawsuit was filed Wednesday in US District Court in Albuquerque.

The lawsuit says the Del Norte High School students were questioned in March 2004 by a police officer and school administrators.

The lawsuit says the US Border Patrol was called to Campus after it was learned the students were illegal immigrants.

The students were ordered to leave the US by June 1st. The lawsuit contends that campuses are safe havens for students.

School, police and Border Patrol officials decline comment.

LOL Campus safe haven for an Illegal?
Just like the Mosques in Iraq where the terrorists hide out because it's a "safe haven" from US soldiers.

So, are all students protected by this safe haven? Or just those of the correct flavor? And does that protection cover all laws? Or is it applicable only to laws that impact students of the correct flavor? It has got to be a stall tactic.

I'm sorry, but I don't understand why these illegal aliens feel they have rights under the US Constitution. Wait, wait, that's right, the loons on the left and their 'advocacy' groups keep trying to finger the people who support immigration reform and securing of the border's as being racist. It's disgusting. If you are here illegally, I don't care where you came from or why you are here...round 'em up and get 'em out.

While that argument may hold true for foreign Embassies, it certainly doesn't for schools. They're US soil, bought and paid for by US taxpayers.

Wonder if they're going to get a jury of their peers? If so, we're screwed, blued, and tattooed!

I think where they are going here is that the Supreme Court has ruled that states have to provide an education to illegal aliens kids. Since the school called the police who in tune call the BP the state violated their right to an education.

There is more to this story. The real question is why did the school call the police in the first place. I guarantee you it had nothing to do with them being illegal. Schools could care less, they get paid by how many seats they fill.

Actually I am surprised the BP showed up at the school in the first place. Generally they will not show up to such places for just these types of reasons. They always get sued.

Thanks for the ping. I remember when they were deporting those kids. It seems the kids didn't get their visa's renewed for some reason. I think the parents were allowed to stay,

While it's true that the SCOTUS has ruled that states must provide a free public school education to illegal alien children, these children are still subject to deportation by ICE. Despite what MALDEF believes, our public schools are not a safe haven for illegal alien children.
