Not necessarily. If they think they can filibuster later, then so can Frist invoke the Constitutional option later. If we get up/down votes on each of these nominees, that is not a defeat. If any of them are denied that, or there is a backroom deal to defeat any of them when they otherwise would have passed, then I would agree with you.
