The Democrats could still avoid the change in the filibuster rule, just by voting for cloture. Actually, I am hoping they won't. Otherwise we have to go through this for each nominee.

They will just delay the vote for a change in filibuster. But then, that might be a good strategy. Allow the nominees for the lower courts through and delay the battle unilt the next SC nominee where RINO's in the Senate will be much more likely to balk at a true conservative judge.

One could always instruct a lot of one's own to vote against the cloture (instruct those who will be voting towards the end of the list, when the things are more clear).

Bad idea to have an overnight session, imho. Why garner the maximum media attention? Just vote the Constitutional Option at 9:30am. Americans will discuss the "24" finale at the water cooler and not the fillibuster.

Please let them actually filibuster. This saying filibuster and everyone gasps is crap. Make the sob's actually stand up and talk. It won't last any more than a few days.

Frist should follow the advice of Dick Morris and force the Democrats to filibuster (for real) for one to two weeks. Morris predicts that if this occurs, the Democrats will look like complete idiots, with the public watching highlights on the news (and live on C-SPAN). The Dims would then incur the wrath of the public, and the MSM would not be able to spin in the Rats favor.

The reason Frist won't do this is because it is "too hard." The Pubbies want to be all snug in their warm little beds too, and they are too lazy to fight in the chamber. Soooo, 24 hours is all we will get.

If Frist does not win the cloture vote, he would seek a ruling of the presiding officer that further debate was dilatory. If the Senate sustained such a ruling by majority vote, then the filibuster-ending threshold would be lowered from 60 to 51.

Is this true?

I assumed that the nuclear option would simply "outlaw" judicial filibusters. This sounds like a change to the cloture rule. I think the article is wrong.

If filibustering judicial appointments causes hair to fall out, then it should be banned.
