Apple faces employee discrimination lawsuit

Apple has been sued by a former employee for alleged discrimination. Shaune Patterson says that she was wrongfully terminated from the company because she was a Lesbian. Formerly employed by Apple as a human resources compensation consultant, she has filed suite in the United States District Court for the Northern District of California in San Francisco. The amended complaint, filed on May 16, 2005, alleges that Shaune Patterson was suspended for one month and then subsequently wrongfully terminated from her position, after she complained that her white counterparts, who were junior to her, were making higher salaries than she was. Patterson alleges that the suspension came one day after she complained of racial discrimination.

Patterson has amended her complaint to include claims of sexual orientation and genetic characteristic discrimination. Prior to her one-month suspension, Patterson alleges that one of Apple's managers wrote a memo describing her as a "rather obese-sized black lesbian." According to Patterson's attorney, Waukeen McCoy, "Apple discounted my client's achievements, choosing to base the decision to discipline not on her performance, but rather on her size, race, and sexual orientation." McCoy was the lead plaintiffs' attorney in one of the largest U.S. History racial discrimination suit, Carroll v. Interstate Brands Corporation, which rendered a verdict for $133 million in August of 2000.

Was a lesbian. It's okay. They can hire her back.

I personally believe in business and property rights in their strictest form. An owner should be able to fire someone for any reason he/she wants.

Apple is still gay in my mind. This is just some lady with a bloodsucking leech lawyer playing the litigation lottery.

The mistake was hiring this maroon in the first place.

It's a lot easier to not hire someone, legally-speaking, than to fire someone.

Other than those three, though, I've got a feeling she's not playing with a full deck.

"Playing the race card, the queer card and the fat card all at the same time."

Five points for creativity. We need a picture.

Let me guess: They were trying to fire a fat black woman who was straight, and they didn't realize Shaune didn't fit one of the criteria.

PR Newswire version of story:

SAN FRANCISCO, May 20 /PRNewswire/ -- A Lesbian, formerly employed by Apple Computer as a human resources compensation consultant, has slapped one of the nation's largest computer manufacturers with a discrimination lawsuit. This lawsuit, filed in the United States District Court for the Northern District of California in San Francisco, may be one of the largest discrimination lawsuits filed against Apple Computer by a Lesbian.

Patterson, who has an MBA from the University of Texas, amended her complaint to include claims of sexual orientation and genetic characteristic discrimination.

First: California is an at-will employment state, meaning that legally a company can fire you for whatever reason they want to.

Second: If someone was dumb enough to write a memo mentioning that she's black and lesbian in an atmosphere of performance review, they are a MORON. All these places drill tolerance classes onto their employees, especially Apple.

Third: Methinks this person has sued before. Just a hunch.

Humor - I used to carpool with a personnel manager; the front desk used to drool over the 5-wayers.

Wait a minute...what about all of this 'Domestic Partners' nonsense that PC (Politically Correct) Corporate America has been shoving down our throats the last few years? And that this is happening in SAN FRANCISCO, the Gay capitol of the U.S.?!! What gives?

Playing the race card, the queer card and the fat card all at the same time.

If "she" also has a scraggly goatee, and somebody dares to post a photo, I'm going to have to pluck my eyes out. I see no other recourse.
