Does the name JoJo Giorgiani ring a bell? My memory's a little hazy at this point, but back in the early '80s a 300+ pound rapist was spared jail time because the prison conditions would have been bad for the poor baby's health. I don't know what ultimately became of him; hopefully he got crushed under the weight of his own fat.

Another case where the right of the accused triumph over justice for the victim. I see the bloody hand of the ACLU in this.

Let's assume that he really cannot communicate facts or ideas to another person and that he's not playacting. And suppose further, he has a perfect alibi but cannot tell his lawyer about it. That's an example of the reason for the rule that you have to be able to participate in your own defense. It's really not such a bad rule.

So setting him free is a better idea? Look, there's always a chance that someone might be wrongly convicted of something, so you do the best you can to get at the truth, however you can. You don't just throw up your hands and let someone who's 99% likely to be a rapist/murderer back on the streets.

He had to be able to communicate to enter this country illegally. He had to be able to communicate to obtain the spurious SS card. He has to communicate to obtain food, drink and a place to hang out. His inability to make his wishes known is selective and ludicrous. And, besides, communications with most defense lawyers today is immaterial -- they simply fabricate a defense strategy to fit the facts. "Suborning perjury" are, in our increasigly secular society, just high-sounding words.
