Frist starts countdown to final vote on nominee

This morning, Senate Majority Leader Bill Frist will take an official step to proceed toward a vote on Owen's nomination, starting the clock ticking toward a showdown over whether Democrats will retain their right to block judicial nominees with the filibuster.

Shortly after the Senate convenes this morning, Frist, R-Tenn., will file a cloture petition, which requires the approval of 60 of 100 senators, to end debate on Owen's nomination.

After the two-day ripening period ends on the cloture petition -- in this scenario on Tuesday -- senators must vote on the cloture motion one hour after the Senate comes into session for the day (as long as enough senators are present for a quorum).

If the cloture vote fails, Frist would direct an inquiry known as a "point of order" to the Senate's presiding officer, who is likely to be Vice President Dick Cheney. In the inquiry, Frist would argue that after extensive debate on a nominee like Owen, filibusters of judicial nominees are out of order.

Looks like Tuesday will be D-day.

If some of the Republican Senators, who are still working on undermining the Republican Senate, succeed in preventing the elimination of the filibuster, everything should be done to recall them, impeach them, and defeat them in the primary in the next election and they should be shunned by all Republicans.

Well if nothing else, Tuesday will be interesting. All hell breaking out in the Senate, politicians accusing each other of every thing in the book, the MSM going bonkers. Can't wait! I love a good fight!

The Dims can pull the rug out from under this by merely voting for cloture. B.Nelson frequently has already. That might, if the Rinos all hold for cloture, get the GOP to 56. Are there four more? They apparently offered votes on all 7 today?

I, too, am really looking forward to the fireworks. I look forward also to almost 4 years of Constitutionalist judges being appointed to the Federal Courts all over this land.

The judgeships are truely the crown jewels of all these years of election battles.

Actually, I think we need them to call for cloture to trigger the Constitutional option. This "call for Cloture" would be ruled by the Chair as out of order or some such sequence of rulings. No one needs to calls for cloture, Frist will call for the vote and if the demonrats are smart, they'll just vote. If they try to obstruct, GOP will change the rules.

Agreed.

Oh, and if Senator Warner's staff is reading this? We do not accept the senate being transfered unconstitutionally the President's individual duty and right to choose his own candidates to present for an up or down vote. If you want that power, WIN THE PRESIDENCY.

Up and down vote on all nominees. We're watching you.

Actually Frist will call for cloture. There will be a cloture vote and then if it fails first will move to have judical appointment not allow to be filibustered.

Pray that the 12 moderates in the middle aren't moderate or stable enough to moderate this nuclear reaction enough to keep it from going to critical mass! IOW, that the k value stays above 1 for the reaction. Keep the collisions coming! (Sorry, I just finished a nuclear physics class and I doubt I'll really be able to use much of the knowledge anywhere else!)

Well, I don't get how it all has to work. But I know the dem leadership does and from todays hearings they sound like they know exactly what's coming! I couldn't be more pleased.

Yeah the Dims seem resigned. But they can always preserve the filitbuster by voting for cloture and saving this battle for another day.
