I can't believe that you think that the teachers deserve to have thier lives destroyed and this girl should be wealthy because she was called a whore behind her back.
I guess we are of different mindsets as I have been falsely accused of many things during my life and a lawsuit never crossed my mind.
I have had customers lie about service that they received here and THAT cost me actual money. Lawsuit didn't cross my mind.
I have had ex-girlfriends spread lies to me to other ladies and guess what, I didn't sue them. If this girl had a case, my detractors should have been sued for millions!
If she is NOT a whore, her friends will know this is BS so her character is not damaged. So what is the lawsuit for? Spite? Revenge? Money? Love of suing?
You believe if someone calls you a name, that person should be sued. I do not. It's clear that we wont be able to come to a mutual understanding on this. Oops! I may have mischaracterized your position on this with my first sentance. If I didn't type this retraction, would I have been liable? LOL!
As I said. I support the teachers termination. Why does everything now a days have to have dollar signs and lawyers in on the action? That's all.
Arioch7 out!
Its pretty clear that you do not believe in slander laws for children.
If that was the case, you could have just said so.
Anything else is just side stepping the initial point.
No matter what anyone says, lies, or claims, nor harm done, no child should ever be allowed civil damages for it.
Simple statement would have been sufficient.
Since this law is there, and will almost certainly meet the standard, let her sue.
I have had ex-girlfriends spread lies to me to other ladies and guess what, I didn't sue them.
If an Ex accused you to other people of raping and child molestation, I guess you wouldn't sue either, since its just a rumor (I'm using that example based on a news story several years ago at a college involving a feminist group).
I wonder if I can go about spreading rumors that some of my tenants are dealing drugs and involved in terrorism, so that it would be easier to evict them for higher rents, if they're anything like you, I could make some awesome extra cash.
You believe if someone calls you a name, that person should be sued.
Nope, not even close, I've been called all types of names before, the closest I ever came to sueing was when I was bidding for a building and a competitor started rumors of impending financial problems (which were not true) and other assorted fabricated stories to prevent the purchase, in that case, the threat to sue was suffice. Even if that deal had fallen through, it would have caused damage to me with alot of other folks that I need for my business.
This teachers motives in doing what she did are suspect. No one is stupid enough to really believe that mono is a "whores" disease. I'd be interested in knowing what her intent was and reason was to malign this girl.
And yes, I know you mischaracterized my belief in the first sentence. I'm generally anti-lawsuit, I've been sued more times then I can for reasons so dumb they defy belief.
As policy I only sue in business related matters, I've only threatened liable or slander when it was being used in an attempt for competitive reasons that would have had long term reprecussions.
Either way, this girl was slandered, by the teacher, and not just as a matter of name calling (i.e. if she had called her an idiot), but presented in a factual manner.
If you don't think kids should ever sue, fine, alot of folks don't. Its just spin if you avoid saying that.
