Judge tosses impersonation charge against Reggie

GRETNA -- A judge has dismissed a police impersonation charge against media consultant and Democratic Party operative Raymond Reggie, ruling that prosecutors waited too long to bring him to trial. Reggie, the brother-in-law of U.S. Sen. Ted Kennedy, had been accused of stopping three women in Metairie by using a blue police light. The charge carried up to two years in prison.
State District Judge Robert Murphy ruled Monday that Reggie's trial on the charge, filed in 2002, should have taken place by July 14, 2004. Defense attorney Mike Ellis said "justice has been served" by the ruling. Prosecutor Kim McElwee said an appeal was planned.
Under state law, noncapital felony cases must be brought to trial within two years after formal charges are filed. McElwee had argued that the law has exceptions that apply to Reggie's case, such as time caused by unresolved pretrial motions.
Reggie, 43, faces sentencing Oct. 26 in New Orleans federal court on unrelated charges of bank fraud and bank fraud conspiracy. He pleaded guilty to those charges on April 21.

The female prosecutor was quoted a week or two as saying she didn't expect to win.
She didn't say exactly why, leaving the reader to speculate, but I'm not surprised and I won't worry too much about it as he did plead guilty to the Federal bank fraud charges.
I really don't know. I guess I'll just have to send each of their offices an e-mail and inquire as to how deep their comity runs and see if I get a response. I like to stir the pot. ;^)
So in essence this judge has ruled that if a defense lawyer can drag things out and delay the trial start for 2 years, the guilty can walk?
Wouldn't be surprised if he's been in the back seat a few times when the blue light was flashing. Always wondered what sort of woman would marry Teddy - now I know: the kind of woman who has a brother like Reggie. Ugh.

That plea was cut as part of the deal in cooperating with the feds on the Clinton campaign business plus one secret investigation that hasn't been made public yet.
Her/his father was convicted of bank fraud and he was good friends with the Edwards Clan of Crowley, LA. Edwards and son also in prison. Now you know. Oh, that would be Governor Edwin Edwards by the way. DemocRATS the whole lot of 'em.

The thing is in most states pretrial motions DO toll speedy trial rights. I wonder whether these were all prosecution motions, or how much the judge was pressured/paid behind the scenes.
